أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ أَنَّهُمَا أَخْبَرَاهُ

أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللهِ ﷺ فَقَالَ أَحَدُهُمَا اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَقَالَ الْآخَرُ وَهُوَ أَفْقَهُهُمَا يَا رَسُولَ اللهِ ائْذَنْ لِي فِي أَنْ أَتَكَلَّمَ قَالَ «تَكَلَّمْ» قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَجَارِيَةٍ ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ مَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَذَكَرَ كَلِمَةً مَعْنَاهَا وَتَغْرِيبُ عَامٍ وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ فَقَالَ رَسُولُ اللهِ ﷺ «أَمَا وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ عَلَيْكَ» وَجَلَدَ يَعْنِي ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا وَأَمَرَ انَيْسًا أَنْ يَأْتِيَ امْرَأَةَ الْآخَرِ فَإِنِ اعْتَرَفَتْ رَجَمَهَا فَاعْتَرَفَتْ فَرَجَمَهَا

✧ Two men brought a dispute to the Messenger of God ﷺ. One of them said: Judge between us by the Book of God. The other, who was more learned of the two, said: O Messenger of God, permit me to speak. He said: “Speak.” He said: My son was a hired worker for this man, and he committed fornication with his wife. They told me that my son was to be stoned, so I ransomed him with a hundred sheep and a slave girl. Then I asked the people of knowledge, and they told me that my son was to receive a hundred lashes—and he mentioned a word meaning exile for a year—and stoning was only upon his wife. The Messenger of God ﷺ said: “Now, by the One in whose hand is my soul, I will judge between you by the Book of God. As for your sheep and your slave girl, they are returned to you.” He flogged his son a hundred times and exiled him for a year, and he ordered Unays to go to the other man’s wife, and if she confessed, to stone her. She confessed, and he stoned her.
