أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ قَالَ حَدَّثَنَا أَزْهَرُ السَّمَّانُ عَنِ ابْنِ عَوْنٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ

أَنَّ عُمَرَ أَصَابَ أَرْضًا بِخَيْبَرَ فَأَتَى النَّبِيَّ ﷺ يَسْتَأْمِرُهُ فِي ذَلِكَ فَقَالَ «إِنْ شِئْتَ حَبَّسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا» فَحَبَّسَ أَصْلَهَا أَنْ لَا يُبَاعَ وَلَا يُوهَبَ وَلَا يُورَثَ فَتَصَدَّقَ بِهَا عَلَى الْفُقَرَاءِ وَالْقُرْبَى وَالرِّقَابِ وَفِي الْمَسَاكِينِ وَابْنِ السَّبِيلِ وَالضَّيْفِ لَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ أَوْ يُطْعِمَ صَدِيقَهُ غَيْرَ مُتَمَوِّلٍ فِيهِ

Translation

✧ That Umar acquired land at Khaybar. He came to the Prophet ﷺ seeking his counsel regarding that. He said, "If you wish, hold back its principal and give it in charity." So he held back its principal, on condition that it not be sold, given as a gift, or inherited. He gave it in charity for the poor, the relatives, the freeing of slaves, for the needy, the wayfarer, and the guest. There is no blame on the one who administers it to eat from it in a reasonable manner or to feed his friend, without enriching himself from it.
