✧ If he wants to free the slave and his mother, with whom should he start?

أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ الْوَاحِدِ قَالَ حَدَّثَنَا مَرْوَانُ قَالَ حَدَّثَنَا اللَّيْثُ وَذَكَرَ آخَرَ قَبْلَهُ قَالَا حَدَّثَنَا عُبَيْدُ اللهِ بْنُ أَبِي جَعْفَرٍ عَنْ الْحَسَنِ بْنِ عَمْرِو بْنِ أُمَيَّةَ الضَّمْرِيِّ

أَنَّهُ حَدَّثَهُ أَنَّ رِجَالًا مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ حَدَّثُوهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «أَيُّمَا أَمَةٍ كَانَتْ تَحْتَ عَبْدٍ فَعَتَقَتْ فَهِيَ بِالْخِيَارِ مَا لَمْ يَطَأْهَا زَوْجُهَا»

✧ He narrated to him that men from the companions of the Messenger of Allah ﷺ narrated to him that the Messenger of Allah ﷺ said: "Any slave woman who is under a slave and then is manumitted has the choice as long as her husband has not had intercourse with her."
