حَدَّثَنَا بِشْرٌ هُوَ ابْنُ الْمُفَضَّلِ، ثَنَا سَوَّارُ بْنُ عَبْدِ اللهِ، حَدَّثَنِي أَبُو ثُمَامَةَ، وَامْرَأَةٌ مِنْ أَهْلِنَا

أَنَّ كِنَانَةَ بْنَ ثَوْرٍ كَانَتْ عِنْدَهُ امْرَأَةٌ قَدْ وَلَدَتْ لَهُ أَوْلَادًا فِي الْجَاهِلِيَّةِ، فَقَالَ لَهَا: مَا فَوْقَ نِطَاقِكِ مُحَرَّمٌ. فَخَاصَمَتْهُ إِلَى الْأَشْعَرِيِّ، فَقَالَ: مَا أَرَدْتَ ؟ قَالَ: الطَّلَاقَ. قَالَ: « فَقَدْ أَبَانَهَا مِنْكَ

Translation

✧ Kinana b. Thawr had a wife who had borne him children in the pre-Islamic era. He said to her: 'What is above your belt is forbidden.' She took her case to al-Ash'ari, who said: 'What did you intend?' He said: 'Divorce.' He said: 'It has separated her from you.'
