حَدَّثَنَا الْعَبَّاسُ بْنُ الْوَلِيدِ، ثَنَا يُوسُفُ - هُوَ السَّمْتِيُّ - ثَنَا جَعْفَرُ بْنُ سَعْدٍ، عَنْ خُبَيْبِ بْنِ سُلَيْمَانَ بْنِ سَمُرَةَ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، عَنْ سَمُرَةَ ؓ قَالَ: إِنَّ رَسُولَ اللهِ ﷺ قَالَ:
مَنْ رَهَنَ أَرْضًا بِدَيْنٍ عَلَيْهِ، فَإِنَّهُ يَقْضِي مِنْ ثَمَرِهَا بِمَا فَضَلَ عَنْ نَفَقَتِهَا، فَيَقْضِي مِنْ ذَلِكَ دَيْنَهُ الَّذِي عَلَيْهِ بَعْدَ أَنْ يَحْسِبَ الَّذِي بَقِيَ لَهُ عِنْدَ عَمَلِهِ وَنَفَقَتِهِ بِالْعَدْلِ

✧ Whoever mortgages land for a debt owed by him, he may pay from its produce what is surplus over its expenses, and then he may pay from that his debt that he owes, after accounting for what remains for him for his work and expenses, justly.
