✧ The spoils and their distribution

أَخْبَرَنَا الْحُسَيْنُ بْنُ إِدْرِيسَ الْأَنْصَارِيُّ قَالَ أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ عَنْ مَالِكٍ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عُمَرَ بْنِ كَثِيرِ بْنِ أَفْلَحَ عَنْ أَبِي مُحَمَّدٍ مَوْلَى أَبِي قَتَادَةَ عَنْ أَبِي قَتَادَةَ الْأَنْصَارِيِّ ثُمَّ السُّلَمِيِّ أَنَّهُ قَالَ

خَرَجْنَا مَعَ رَسُولِ اللَّهِ ﷺ عَامَ حُنَيْنٍ فَلَمَّا الْتَقَيْنَا كَانَتْ لِلْمُسْلِمِينَ جَوْلَةٌ قَالَ فَرَأَيْتُ رَجُلًا مِنَ الْمُشْرِكِينَ قَدْ عَلَا رَجُلًا مِنَ الْمُسْلِمِينَ قَالَ فَاسْتَدْبَرْتُ لَهُ حَتَّى أَتَيْتُ مِنْ وَرَائِهِ فَضَرَبْتُهُ عَلَى حَبْلِ عَاتِقِهِ ضَرْبَةً فَقَطَعْتُ الدِّرْعَ فَأَقْبَلَ عَلَيَّ فَضَمَّنِي ضَمَّةً وَجَدْتُ فِيهَا رِيحَ الْمَوْتِ ثُمَّ أَدْرَكَهُ الْمَوْتُ فَأَرْسَلَنِي فَلَحِقْتُ عُمَرَ بْنَ الْخَطَّابِ فَقُلْتُ مَا بَالُ النَّاسِ؟ فَقَالَ أَمْرُ اللَّهِ قَالَ ثُمَّ إِنَّ النَّاسَ قَدْ رَجَعُوا فَقَالَ رَسُولُ اللَّهِ ﷺ «مَنْ قَتَلَ قَتِيلًا لَهُ عَلَيْهِ بَيِّنَةٌ فَلَهُ سَلَبُهُ» قَالَ أَبُو قَتَادَةَ فَقُمْتُ فَقُلْتُ مَنْ يَشْهَدُ لِي؟ ثُمَّ جَلَسْتُ ثُمَّ قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ قَتَلَ قَتِيلًا لَهُ عَلَيْهِ بَيِّنَةٌ فَلَهُ سَلَبُهُ» فَقُمْتُ ثُمَّ قُلْتُ مَنْ يَشْهَدُ لِي ثُمَّ جَلَسْتُ ثُمَّ قَالَ ذَلِكَ الثَّالِثَةَ فَقُمْتُ فَقَالَ رَسُولُ اللَّهِ ﷺ «مَا بَالُكَ يَا أَبَا قَتَادَةَ» قَالَ فَقَصَصْتُ عَلَيْهِ الْقِصَّةَ فَقَالَ رَجُلٌ مِنَ الْقَوْمِ صَدَقَ يَا رَسُولَ اللَّهِ وَسَلَبُ ذَلِكَ الْقَتِيلِ عِنْدِي فَأَرْضِهِ مِنِّي فَقَالَ أَبُو بَكْرٍ الصِّدِّيقُ رِضْوَانُ اللَّهِ عَلَيْهِ لَاهَا اللَّهِ إِذًا يَعْمِدُ إِلَى أَسَدٍ مِنْ أُسْدِ اللَّهِ يُقَاتِلُ عَنِ اللَّهِ وَعَنْ رَسُولِهِ فَيُعْطِيكَ سَلَبَهُ قَالَ رَسُولُ اللَّهِ ﷺ «صَدَقَ فَأَعْطِهِ إِيَّاهُ» فَقَالَ أَبُو قَتَادَةَ فَأَعْطَانِيهِ فَبِعْتُ الدِّرْعَ فَابْتَعْتُ بِهِ مَخْرَفًا فِي بَنِي سَلَمَةَ فَإِنَّهُ لَأَوَّلُ مَالٍ تَأَثَّلْتُهُ فِي الْإِسْلَامِ

✧ We went out with the Messenger of Allah ﷺ in the year of Hunayn. When we met, the Muslims had a retreat. I saw a man from the polytheists over a man from the Muslims. I came behind him and struck him on the shoulder strap, cutting the coat of mail. He turned to me and squeezed me in an embrace in which I found the smell of death. Then death overtook him, and he released me. I caught up with ‘Umar b. al-Khattab and said: “What is the matter with the people?” He said: “The command of Allah.” Then the people returned, and the Messenger of Allah ﷺ said: «Whoever kills a slain man, and he has evidence for it, his spoils belong to him.» Abu Qatadah said: I stood up and said: “Who will testify for me?” Then I sat down. The Messenger of Allah ﷺ said: «Whoever kills a slain man, and he has evidence for it, his spoils belong to him.» I stood up and said: “Who will testify for me?” Then I sat down. He said that the third time, and I stood up. The Messenger of Allah ﷺ said: «What is the matter with you, O Abu Qatadah?» I told him the story. A man from the people said: “He spoke the truth, O Messenger of Allah, and the spoils of that slain man are with me, so satisfy him from me.” Abu Bakr al-Siddiq, ؓ, said: “By Allah, no! He would intend a lion of Allah’s lions fighting for Allah and His Messenger, and you give you his spoils.” The Messenger of Allah ﷺ said: «He spoke the truth, so give it to him.» Abu Qatadah said: He gave it to me. I sold the coat of mail and bought with it a garden among the Banu Salamah. It was the first property I acquired in Islam.
