machine translationYazīd b. Hārūn narrated to us: Muḥammad b. Isḥāq informed us, from Abū Jaʿfar Muḥammad b. ʿAlī; and from al-Zuhrī, from Saʿīd b. al-Musayyab; and from Abān b. Ṣāliḥ, from Mujāhid; they said:

Two women of Ḥamal b. Mālik b. al-Nābighah's household were jealous of each other (co-wives). One of them attacked the other with a tent pole and struck her, so she miscarried what was in her womb and died. The matter was brought to the Messenger of Allah ﷺ, and he ruled that her blood money (diyah) be paid by the ʿāqilah (the paternal kin) of the woman who killed her, and he ruled for the fetus a ghurrah: a male or female slave. The father of the killer, or her uncle, said: "Shall I pay for one who neither ate nor drank, nor cried out nor made a sound at birth? Such a one is nullified (yuṭall)!" The Messenger of Allah ﷺ said: "This man speaks with the speech of a poet. Yes, for it a ghurrah: a male slave or a female slave."</parameter>
