حَدَّثَنَا غُنْدَرٌ عَنْ شُعْبَةَ قَالَ:
سَأَلْتُ الْحَكَمَ وَحَمَّادًا عَنْ حُرٍّ وَعَبْدٍ اصْطَدَمَا فَمَاتَا ؟ قَالَا: أَمَّا دِيَةُ الْحُرِّ فَلَيْسَتْ عَلَى الْمَمْلُوكِ، وَأَمَّا دِيَةُ الْمَمْلُوكِ فَعَلَى الْعَاقِلَةِ
