حَدَّثَنَا ابْنُ إِدْرِيسَ، عَنْ هِشَامٍ، عَنِ الْحَسَنِ قَالَ:
إِنَّ الرَّهْنَ الْمَقْبُوضَ إِذَا مَاتَ صَاحِبُهُ أَوْ أَفْلَسَ فَالَّذِي هُوَ فِي يَدِهِ أَحَقُّ بِهِ، فَإِنْ لَمْ يَكُنْ مَقْبُوضًا فَهُوَ بَيْنَ الْغُرَمَاءِ
