Some matters that occurred between the Messenger ﷺ and the Jews, Christians, and hypocrites in al-Madinah al-Munawwarah
[ ظُلْمُهُمْ فِي الدِّيَةِ ] قَالَ ابْنُ إسْحَاقَ: وَحَدَّثَنِي داوُدَ بْنُ الْحُصَيْنِ عَنْ عِكْرِمَةَ، عَنْ ابْنِ عَبَّاسٍ: أَنَّ الْآيَاتِ مِنْ الْمَائِدَةِ الَّتِي قَالَ اللَّهُ فِيهَا: فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ وَإِنْ تُعْرِضْ عَنْهُمْ فَلَنْ يَضُرُّوكَ شَيْئًا وَإِنْ حَكَمْتَ فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ إنَّمَا أُنْزِلَتْ فِي الدِّيَةِ بَيْنَ بَنِي النَّضِيرِ وَبَيْنَ بَنِي قُرَيْظَةَ، وَذَلِكَ أَنَّ قَتْلَى بَنِي النَّضِيرِ، وَكَانَ لَهُمْ شَرَفٌ، يُؤَدُّونَ الدِّيَةَ كَامِلَةً، وَأَنَّ بَنِي قُرَيْظَةَ ( كَانُوا ) يُؤَدُّونَ نِصْفَ الدِّيَةِ، فَتَحَاكَمُوا فِي ذَلِكَ إلَى رَسُولِ اللَّهِ ﷺ، فَأَنْزَلَ اللَّهُ ذَلِكَ فِيهِمْ، فَحَمَلَهُمْ رَسُولُ اللَّهِ ﷺ عَلَى الْحَقِّ فِي ذَلِكَ، فَجَعَلَ الدِّيَةَ سَوَاءً. قَالَ ابْنُ إسْحَاقَ: فَاَللَّهُ أَعْلَمُ أَيُّ ذَلِكَ كَانَ.
Translation
✧ [Their injustice regarding blood money] Ibn Isḥāq said: Dāwūd b. al-Ḥuṣayn narrated to me, from ʿIkrimah, from Ibn ʿAbbās: The verses of al-Māʾidah in which Allah said: “So judge between them or turn away from them. And if you turn away from them, they will never harm you at all. And if you judge, then judge between them with justice. Indeed, Allah loves those who act justly” were revealed concerning blood money between the Banū al-Naḍīr and the Banū Qurayẓah. That is because the slain of the Banū al-Naḍīr, who had nobility, were paid full blood money, while the Banū Qurayẓah were paid half the blood money. So they took the matter to the Messenger of Allah ﷺ for judgment. Allah then revealed this regarding them, and the Messenger of Allah ﷺ made them adhere to the truth in that matter, making the blood money equal. Ibn Isḥāq said: Allah knows best which of these it was.
