وفي رَمَضَانَ سنة إحدى ومائة عَزَلَ يزيد بن عبد الملك عَنْ إِمْرَةِ الْمَدِينَةِ أَبَا بَكْرِ بْنَ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، وَوَلَّى عَلَيْهَا عَبْدَ الرَّحْمَنِ بْنَ الضَّحَّاكِ بْنِ قَيْسٍ وَاسْتَقْضَى عَبْدَ الرَّحْمَنِ سَلَمَةَ بْنَ عَبْدِ اللَّهِ بْنِ الْأَسَدِ الْمَخْزُومِيَّ، وَأَرَادَ مُعَارَضَةَ ابْنِ حَزْمٍ فَلَمْ يَجِدْ عَلَيْهِ سَبِيلًا، حَتَّى شَكَا عُثْمَانُ بْنُ حَيَّانَ إِلَى يَزِيدَ بْنِ عَبْدِ الْمَلِكِ مِنِ ابْنِ حَزْمٍ، وَأَنَّهُ ضَرَبَهُ حَدَّيْنِ، وَطَلَبَ مِنْهُ أَنْ يُقِيدَهُ مِنْهُ، فَكَتَبَ يَزِيدُ إِلَى عَبْدِ الرَّحْمَنِ بْنِ الضَّحَّاكِ كِتَابًا: أَمَّا بَعْدُ فَانْظُرْ فِيمَا ضَرَبَ ابْنُ حَزْمٍ ابْنَ حَيَّانَ، فَإِنْ كَانَ ضَرَبَهُ فِي أَمْرٍ بَيِّنٍ أَوْ أَمْرٍ يُخْتَلَفُ فِيهِ، فَلَا تَلْتَفِتُ إِلَيْهِ. فَأَرْسَلَ ابْنُ الضَّحَّاكِ فَأَحْضَرَ ابْنَ حَزْمٍ، وَضَرَبَهُ حَدَّيْنِ فِي مَقَامٍ وَاحِدٍ، وَلَمْ يَسْأَلْهُ عَنْ شَيْءٍ.
Translation
✧ In Ramaḍān of the year one hundred and one, Yazīd b. ʿAbd al-Malik dismissed Abū Bakr b. Muḥammad b. ʿAmr b. Ḥazm from the governorship of Madinah, and appointed over it ʿAbd al-Raḥmān b. al-Ḍaḥḥāk b. Qays. ʿAbd al-Raḥmān appointed as judge Salamah b. ʿAbd Allāh b. al-Asad al-Makhzūmī. He intended to investigate Ibn Ḥazm but found no way against him, until ʿUthmān b. Ḥayyān complained to Yazīd b. ʿAbd al-Malik about Ibn Ḥazm, saying that he had inflicted two ḥadd punishments on him, and asked him to exact retaliation for him from him. So Yazīd wrote to ʿAbd al-Raḥmān b. al-Ḍaḥḥāk a letter: "Now then, look into the matter of Ibn Ḥazm's beating Ibn Ḥayyān. If he beat him in a clear matter or a matter about which there is disagreement, then pay no attention to it." Ibn al-Ḍaḥḥāk sent for Ibn Ḥazm, had him brought, and inflicted two ḥadd punishments on him in one session, without asking him about anything.
