✧ “The Messenger of Allah ﷺ ruled that the debt is to be paid before the bequest.” And you recite: {after any bequest that may have been made or debt} [al-Nisa' 12]. And that the offspring of the maternal brothers inherit to the exclusion of the offspring of the paternal half-brothers, and brothers from the mother and brothers from both father and mother are closer than brothers from the father.
Notes
machine translation"This is a hadith that people narrated from Abū Isḥāq and al-Ḥārith b. ʿAbdillāh by way of the path; for that reason the two Shaykhs did not include it. This legal ruling has been authentically reported from Zayd b. Thābit." Al-Dhahabī remained silent about it in al-Talkhīṣ.

- Abū Bakr Aḥmad b. al-Ḥusayn al-Bayhaqī
machine translationThe scholars of hadith refrained from affirming this because al-Ḥārith al-Aʿwar was alone in narrating it from ʿAlī, and al-Ḥārith's report is not taken as evidence because the memorizers (ḥuffāẓ) criticized him. [The beginning of the sentence is incomplete in the Arabic: "mtināʿ" seems to be "imtināʿ".]
