حَدَّثَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ الْجَرَّاحِ الْعَدْلُ الْحَافِظُ بِمَرْوَ ثنا عَبْدُ اللَّهِ بْنُ يَحْيَى الْقَاضِي السَّرَخْسِيُّ ثنا رَجَاءُ بْنُ مُرَجًّى الْحَافِظُ قَالَ اجْتَمَعْنَا فِي مَسْجِدِ الْخَيْفِ أَنَا وَأَحْمَدُ بْنُ حَنْبَلٍ وَعَلِيُّ بْنُ الْمَدِينِيِّ وَيَحْيَى بْنُ مَعِينٍ فَتَنَاظَرُوا فِي مَسِّ الذَّكَرِ فَقَالَ يَحْيَى بْنُ مَعِينٍ يَتَوَضَّأُ مِنْهُ وَقَالَ عَلِيُّ بْنُ الْمَدِينِيِّ بِقَوْلِ الْكُوفِيِّينَ وَتَقَلَّدَ قَوْلَهُمْ وَاحْتَجَّ يَحْيَى بْنُ مَعِينٍ بِحَدِيثِ بُسْرَةَ بِنْتِ صَفْوَانَ وَاحْتَجَّ عَلِيُّ بْنُ الْمَدِينِيِّ بِحَدِيثِ قَيْسِ بْنِ طَلْقٍ عَنْ أَبِيهِ وَقَالَ لِيَحْيَى بْنِ مَعِينٍ كَيْفَ تَتَقَلَّدُ إِسْنَادَ بُسْرَةَ وَمَرْوَانُ إِنَّمَا أُرْسِلَ شُرْطِيًّا حَتَّى رَدَّ جَوَابَهَا إِلَيْهِ فَقَالَ يَحْيَى ثُمَّ لَمْ يُقْنِعْ ذَلِكَ عُرْوَةَ حَتَّى أَتَى بُسْرَةَ فَسَأَلَهَا وَشَافَهَتْهُ بِالْحَدِيثِ ثُمَّ قَالَ يَحْيَى وَلَقَدْ أَكْثَرَ النَّاسُ فِي قَيْسِ بْنِ طَلْقٍ وَأَنَّهُ لَا يُحْتَجُّ بِحَدِيثِهِ فَقَالَ أَحْمَدُ بْنُ حَنْبَلٍ كِلَا الْأَمْرَيْنِ عَلَى مَا قُلْتُمَا فَقَالَ يَحْيَى مَالِكٌ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّهُ تَوَضَّأَ مِنْ مَسِّ الذَّكَرِ فَقَالَ عَلِيٌّ كَانَ ابْنُ مَسْعُودٍ يَقُولُ لَا يُتَوَضَّأُ مِنْهُ وَإِنَّمَا هُوَ بَضْعَةٌ مِنْ جَسَدِكَ فَقَالَ يَحْيَى عَنْ مَنْ فَقَالَ عَنْ سُفْيَانَ عَنْ أَبِي قَيْسٍ عَنْ هُزَيْلٍ عَنْ عَبْدِ اللَّهِ وَإِذَا اجْتَمَعَ ابْنُ مَسْعُودٍ وَابْنُ عُمَرَ وَاخْتَلَفَا فَابْنُ مَسْعُودٍ أَوْلَى أَنْ يُتَّبَعَ فَقَالَ لَهُ أَحْمَدُ بْنُ حَنْبَلٍ نَعَمْ وَلَكِنْ أَبُو قَيْسٍ الْأَوْدِيُّ لَا يُحْتَجُّ بِحَدِيثِهِ فَقَالَ عَلِيٌّ حَدَّثَنِي أَبُو نُعَيْمٍ ثنا مِسْعَرٌ عَنْ عُمَيْرِ بْنِ سَعِيدٍ عَنْ عَمَّارِ بْنِ يَاسِرٍ قَالَ مَا أُبَالِي مَسِسْتُهُ أَوْ أتَّقِي فَقَالَ أَحْمَدُ عَمَّارُ وَابْنُ عُمَرَ اسْتَوَيَا فَمَنْ شَاءَ أَخَذَ بِهَذَا وَمَنْ شَاءَ أَخَذَ بِهَذَا فَقَالَ يَحْيَى بَيْنَ عُمَيْرِ بْنِ سَعِيدٍ وَعَمَّارِ بْنِ يَاسِرٍ مَفَازَةٌ
Translation
✧ Abu Bakr Muhammad b. 'Abdullah b. al-Jarrah al-'Adl al-Hafiz narrated to us in Marw, 'Abdullah b. Yahya al-Qadi al-Sarakhsi narrated to us, Raja' b. Murajja al-Hafiz narrated to us, he said: We gathered in the mosque of al-Khayf: I, Ahmad b. Hanbal, 'Ali b. al-Madini, and Yahya b. Ma'in. They debated about touching the penis. Yahya b. Ma'in said: One performs ablution from it. 'Ali b. al-Madini held the view of the Kufans and adhered to their opinion. Yahya b. Ma'in argued with the hadith of Busrah bt. Safwan, and 'Ali b. al-Madini argued with the hadith of Qays b. Talq from his father. He said to Yahya b. Ma'in: How can you adhere to the chain of Busrah, when Marwan was only sent as a policeman until he brought her answer back to him? Yahya said: Then that did not satisfy 'Urwah until he came to Busrah and asked her, and she directly told him the hadith. Then Yahya said: People have spoken much about Qays b. Talq, and that his hadith is not to be used as proof. Ahmad b. Hanbal said: Both matters are as you two have said. Yahya said: Malik from Nafi' from Ibn 'Umar that he performed ablution from touching the penis. 'Ali said: Ibn Mas'ud used to say: One does not perform ablution from it; it is only a part of your body. Yahya said: From whom? He said: From Sufyan from Abu Qays from Huzayl from 'Abdullah. And when Ibn Mas'ud and Ibn 'Umar meet and differ, Ibn Mas'ud is more worthy to be followed. Ahmad b. Hanbal said to him: Yes, but Abu Qays al-Awdi's hadith is not to be used as proof. 'Ali said: Abu Nu'aym narrated to me, Mis'ar narrated to us, from 'Umayr b. Sa'id from 'Ammar b. Yasir, he said: I do not care whether I touch it or take precaution (not to). Ahmad said: 'Ammar and Ibn 'Umar are equal, so whoever wishes takes this, and whoever wishes takes that. Yahya said: Between 'Umayr b. Sa'id and 'Ammar b. Yasir there is a desert.
