أَخْبَرَنَا أَبُو عَبْدِ اللَّهِ مُحَمَّدُ بْنُ عَلِيٍّ الْجَوْهَرِيُّ بِبَغْدَادَ ثنا أَبُو الْوَلِيدِ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ بُرْدٍ ثنا مُحَمَّدُ بْنُ كَثِيرٍ الْمِصِّيصِيُّ ثنا الْأَوْزَاعِيُّ وَحَدَّثَنَا أَبُو عَلِيٍّ الْحُسَيْنُ بْنُ عَلِيٍّ الْحَافِظُ ثنا جَمَاهِرُ بْنُ مُحَمَّدٍ الْغَسَّانِيُّ بِدِمَشْقَ ثنا مَحْمُودُ بْنُ خَالِدٍ الدِّمَشْقِيُّ ثنا الْفِرْيَابِيُّ عَنِ الْأَوْزَاعِيِّ عَنِ الزُّهْرِيِّ عَنْ حَرَامِ بْنِ مُحَيِّصَةَ الْأَنْصَارِيِّ عَنِ الْبَرَاءِ بْنِ عَازِبٍ قَالَ

كَانَتْ لَهُ نَاقَةٌ ضَارِيَةٌ فَدَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ فَكُلِّمَ رَسُولُ اللَّهِ ﷺ فِيهَا «فَقَضَى أَنَّ حِفْظَ الْحَوَائِطِ بِالنَّهَارِ عَلَى أَهْلِهَا وَأَنَّ حِفْظَ الْمَاشِيَةِ بِاللَّيْلِ عَلَى أَهْلِهَا وَإِنَّ عَلَى أَهْلِ الْمَاشِيَةِ مَا أَصَابَتْ مَاشِيَتُهُمْ»

✧ He had a vicious she-camel that entered a garden and damaged it. The Messenger of Allah ﷺ was spoken to about it, and he ruled that guarding gardens by day is the responsibility of their owners, and guarding livestock by night is the responsibility of their owners, and the owners of livestock are liable for what their livestock damages.
