Sunan ad-Darimi 3305

✧ The will for the heir.

حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ حَدَّثَنَا وَرْقَاءُ عَنْ ابْنِ أَبِي نَجِيحٍ عَنْ عَطَاءٍ عَنْ ابْنِ عَبَّاسٍ قَالَ

«كَانَ الْمَالُ لِلْوَلَدِ وَكَانَتِ الْوَصِيَّةُ لِلْوَالِدَيْنِ وَالْأَقْرَبِينَ فَنَسَخَ اللَّهُ مِنْ ذَلِكَ مَا أَحَبَّ فَجَعَلَ لِلذَّكَرِ مِثْلَ حَظِّ الْأُنْثَيَيْنِ وَجَعَلَ لِلْأَبَوَيْنِ لِكُلِّ وَاحِدٍ مِنْهُمَا السُّدُسَ وَالثُّلُثَ وَجَعَلَ لِلْمَرْأَةِ الثُّمُنَ وَالرُّبُعَ وَلِلزَّوْجِ الشَّطْرَ وَالرُّبُعَ»

Translation

Chain of narrators

✧ The property belonged to the children, and the bequest was for the parents and near relatives. Then Allah abrogated of that what He willed, and He appointed for the male the like of the share of two females, and appointed for the parents for each one of them the sixth and the third, and appointed for the wife the eighth and the fourth, and for the husband the half and the fourth.
