Sunan ad-Darimi 3235

✧ In that which recommends more than a third

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ عَنْ عَامِرٍ عَنْ شُرَيْحٍ

فِي الرَّجُلِ يُوصِي بِأَكْثَرَ مِنْ ثُلُثِهِ قَالَ إِنْ أَجَازَتْهُ الْوَرَثَةُ أَجَزْنَاهُ وَإِنْ قَالَتِ الْوَرَثَةُ أَجَزْنَاهُ فَهُمْ بِالْخِيَارِ إِذَا نَفَضُوا أَيْدِيَهُمْ مِنَ الْقَبْرِ

Translation

✧ Concerning a man who bequeaths more than a third, he said: If the heirs permit it, we permit it. And if the heirs say we permit it, they have the choice when they lower their hands from the grave.
