حَدَّثَنَا زَكَرِيَّا بْنُ عَدِيٍّ حَدَّثَنَا عُبَيْدُ اللَّهِ هُوَ ابْنُ عَمْرٍو عَنْ عَبْدِ الْكَرِيمِ عَنْ الْحَكَمِ قَالَ

«إِذَا قَتَلَ الرَّجُلُ أَخَاهُ عَمْدًا لَمْ يُوَرَّثْ مِنْ مِيرَاثِهِ وَلَا مِنْ دِيَتِهِ فَإِذَا قَتَلَهُ خَطَأً وُرِّثَ مِنْ مِيرَاثِهِ وَلَمْ يُوَرَّثْ مِنْ دِيَتِهِ» قَالَ وَكَانَ عَطَاءٌ يَقُولُ ذَلِكَ

Translation

✧ If a man kills his brother intentionally, he does not inherit from his estate nor from his blood money. But if he kills him accidentally, he inherits from his estate but does not inherit from his blood money. He said: Ata used to say that.
