أَخْبَرَنَا مُحَمَّدُ بْنُ الْعَلَاءِ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ إِدْرِيسَ عَنْ ابْنِ جُرَيْجٍ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ قَالَ

قَضَى رَسُولُ اللَّهِ ﷺ بِالشُّفْعَةِ فِي كُلِّ شِرْكٍ لَمْ يُقْسَمْ رَبْعَةٍ أَوْ حَائِطٍ لَا يَحِلُّ لَهُ أَنْ يَبِيعَ حَتَّى يُؤْذِنَ شَرِيكَهُ فَإِنْ شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ فَإِنْ بَاعَ وَلَمْ يُؤْذِنْهُ فَهُوَ أَحَقُّ بِهِ قِيلَ لِأَبِي مُحَمَّدٍ تَقُولُ بِهَذَا؟ قَالَ «نَعَمْ»

Translation

✧ The Messenger of Allah ﷺ ruled in favor of preemption in every unpartitioned share, whether a dwelling or a garden. It is not lawful for him to sell until he notifies his partner. If he wishes, he may take it, and if he wishes, he may leave it. If he sells without notifying him, then he (the partner) has more right to it.” It was said to Abu Muhammad: “Do you hold this opinion?” He said: “Yes.”
