أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ أَنبأَنَا عَبْدُ الْمَلِكِ بْنُ أَبِي سُلَيْمَانَ قَالَ سَمِعْتُ سَعِيدَ بْنَ جُبَيْرٍ يَقُولُ

سُئِلْتُ عَنِ الْمُتَلَاعِنَيْنِ فِي إِمَارَةِ مُصْعَبِ بْنِ الزُّبَيْرِ أَيُفَرَّقُ بَيْنَهُمَا؟ فَمَا دَرَيْتُ مَا أَقُولُ قَالَ فَقُمْتُ حَتَّى أَتَيْتُ مَنْزِلَ عَبْدِ اللَّهِ بْنِ عُمَرَ فَقُلْتُ لِلْغُلَامِ اسْتَأْذِنْ لِي عَلَيْهِ فَقَالَ إِنَّهُ قَائِلٌ لَا تَسْتَطِيعُ أَنْ تَدْخُلَ عَلَيْهِ قَالَ فَسَمِعَ ابْنُ عُمَرَ صَوْتِي فَقَالَ ابْنُ جُبَيْرٍ فَقُلْتُ نَعَمْ فَقَالَ ادْخُلْ فَمَا جَاءَ بِكَ هَذِهِ السَّاعَةَ إِلَّا حَاجَةٌ قَالَ فَدَخَلْتُ عَلَيْهِ فَوَجَدْتُهُ وَهُوَ مُفْتَرِشٌ بَرْذَعَةَ رَحْلِهِ مُتَوَسِّدٌ مِرْفَقَةً أَوْ قَالَ نُمْرُقَةً شَكَّ عَبْدُ اللَّهِ حَشْوُهَا لِيفٌ فَقُلْتُ يَا أَبَا عَبْدِ الرَّحْمَنِ الْمُتَلَاعِنَانِ أَيُفَرَّقُ بَيْنَهُمَا؟ قَالَ سُبْحَانَ اللَّهِ نَعَمْ إِنَّ أَوَّلَ مَنْ سَأَلَ عَنْ ذَلِكَ فُلَانٌ فَقَالَ يَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْكَ أَرَأَيْتَ لَوْ أَنَّ أَحَدَنَا رَأَى امْرَأَتَهُ عَلَى فَاحِشَةٍ كَيْفَ يَصْنَعُ؟ إِنْ سَكَتَ سَكَتَ عَلَى أَمْرٍ عَظِيمٍ وَإِنْ تَكَلَّمَ فَمِثْلُ ذَلِكَ؟ قَالَ فَسَكَتَ رَسُولُ اللَّهِ ﷺ فَلَمْ يُجِبْهُ فَقَامَ لِحَاجَتِهِ فَلَمَّا كَانَ بَعْدَ ذَلِكَ أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ الَّذِي سَأَلْتُكَ عَنْهُ قَدِ ابْتُلِيتُ بِهِ قَالَ فَأَنْزَلَ اللَّهُ تَعَالَى هَؤُلَاءِ الْآيَاتِ الَّتِي فِي سُورَةِ النُّورِ {وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُنْ لَّهُمْ شُهَدَاءُ إِلَّا أَنْفُسُهُمْ فَشَهَادَةُ أَحَدِهِمْ أَرْبَعُ شَهَادَاتٍ بِاللهِ إِنَّهُ لَمِنَ الصَّادِقِينَ وَالْخَامِسَةُ أَنَّ لَعْنَةَ اللهِ عَلَيْهِ إِن كَانَ مِنَ الْكَاذِبِينَ وَيَدْرَأُ عَنْهَا الْعَذَابَ أَن تَشْهَدَ أَرْبَعَ شَهَادَاتٍ بِاللهِ إِنَّهُ لَمِنَ الْكَاذِبِينَ وَالْخَامِسَةَ أَنَّ غَضَبَ اللهِ عَلَيْهَا إِن كَانَ مِنَ الصَّادِقِين} َحتى ختم هَؤُلَاءِ الْآيَاتِ قَالَ فَدَعَا الرَّجُلَ فَتَلَاهُنَّ عَلَيْهِ وَذَكَّرَهُ بِاللَّهِ وَأَخْبَرَهُ أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ فَقَالَ مَا كَذَبْتُ عَلَيْهَا ثُمَّ دَعَا الْمَرَأَةَ فَوَعَظَهَا وَذَكَّرَهَا وَأَخْبَرَهَا أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ إِنَّهُ لَكَاذِبٌ فَدَعَا الرَّجُلَ فَشَهِدَ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنَ الصَّادِقِينَ وَالْخَامِسَةُ أَنَّ لَعْنَةَ اللَّهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ ثُمَّ أُتِيَ بِالْمَرْأَةِ فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنَ الْكَاذِبِينَ وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ ثُمَّ فَرَّقَ بَيْنَهُمَا

✧ I was asked about the two who engage in li'an during the governorship of Mus'ab b. al-Zubayr, whether they are to be separated. I did not know what to say. So I stood up and went to the house of 'Abd Allah b. 'Umar. I said to the servant, "Ask permission for me to enter." He said, "He is taking a midday nap; you will not be able to enter upon him." Ibn 'Umar heard my voice and said, "Ibn Jubayr?" I said, "Yes." He said, "Enter. Nothing brought you at this hour except a need." So I entered upon him and found him using the saddle pad of his mount as a mat and a cushion as a pillow—or he said a small pillow—'Abd Allah was uncertain—stuffed with palm fiber. I said, "O Abu 'Abd al-Rahman, the two who engage in li'an, are they to be separated?" He said, "Glory be to Allah, yes. The first person to ask about that was so-and-so. He said, 'O Messenger of Allah, may Allah bless you, what do you think if one of us sees his wife committing an indecency, how should he act? If he remains silent, he remains silent about a grave matter, and if he speaks, it is the same.'" He said, "The Messenger of Allah ﷺ remained silent and did not answer him. Then he stood up for his need. After that, he came to the Prophet ﷺ and said, 'O Messenger of Allah, the matter I asked you about has befallen me.'" He said, "Then Allah Most High sent down these verses in Surat al-Nur: 'And those who accuse their wives and have no witnesses except themselves, then the testimony of one of them is four testimonies by Allah that he is truthful, and the fifth that the curse of Allah be upon him if he is lying. And it will avert the punishment from her if she testifies four testimonies by Allah that he is lying, and the fifth that the wrath of Allah be upon her if he is truthful.'" Until he finished these verses. He said, "Then he summoned the man and recited them to him, reminded him of Allah, and told him that the punishment of this world is lighter than the punishment of the Hereafter. The man said, 'I have not lied about her.' Then he summoned the woman, admonished her, reminded her, and told her that the punishment of this world is lighter than the punishment of the Hereafter. She said, 'By the One who sent you with truth, he is lying.' Then he called the man, and he testified four testimonies by Allah that he was truthful, and the fifth that the curse of Allah be upon him if he was lying. Then the woman was brought, and she testified four testimonies by Allah that he was lying, and the fifth that the wrath of Allah be upon her if he was truthful. Then he separated them."
