✧ Prohibition of marriage without a guardian

حَدَّثَنَا أَبُو عَاصِمٍ عَنْ ابْنِ جُرَيْجٍ عَنْ سُلَيْمَانَ بْنِ مُوسَى عَنْ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ عَنِ النَّبِيِّ ﷺ قَالَ
أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذْنِ وَلِيِّهَا فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَإِنِ اشْتَجَرُوا قَالَ أَبُو عَاصِمٍ وَقَالَ مَرَّةً فَإِنْ تَشَاجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ فَإِنْ أَصَابَهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا

✧ Any woman married without her guardian's permission, her marriage is void, her marriage is void, her marriage is void. If they dispute—Abu 'Asim said, and he said once: if they dispute—then the ruler is the guardian of the one who has no guardian. If he has consummated with her, she is entitled to the dowry for what he made lawful of her private part.
