✧ On Wudu from What Exits the Body Such as Nosebleed, Vomiting, Cupping, and the Like

حَدَّثَنَا مُحَمَّدُ بْنُ الْحَسَنِ النَّقَّاشُ نا عَبْدُ اللَّهِ بْنُ يَحْيَى الْقَاضِي السَّرَخْسِيُّ نا رَجَاءُ بْنُ مَرْجَاءَ الْحَافِظُ

قَالَ اجْتَمَعْنَا فِي مَسْجِدِ الْخَيْفِ أَنَا وَأَحْمَدُ بْنُ حَنْبَلٍ وَعَلِيُّ بْنُ الْمَدِينِيِّ وَيَحْيَى بْنُ مَعِينٍ فَتَنَاظَرُوا فِي مَسِّ الذَّكَرِ فَقَالَ يَحْيَى يُتَوَضَّأُ مِنْهُ وَقَالَ عَلِيُّ بْنُ الْمَدِينِيِّ بِقَوْلِ الْكُوفِيِّينَ وَتَقَلَّدَ قَوْلَهُمْ وَاحْتَجَّ يَحْيَى بْنُ مَعِينٍ بِحَدِيثِ بُسْرَةَ بِنْتِ صَفْوَانَ وَاحْتَجَّ عَلِيُّ بْنُ الْمَدِينِيِّ بِحَدِيثِ قَيْسِ بْنِ طَلْقٍ وَقَالَ لِيَحْيَى كَيْفَ تَتَقَلَّدَ إِسْنَادَ بُسْرَةَ وَمَرْوَانُ أَرْسَلَ شَرْطِيًّا حَتَّى رَدَّ جَوَابَهَا إِلَيْهِ فَقَالَ يَحْيَى وَقَدْ أَكْثَرَ النَّاسُ فِي قَيْسِ بْنِ طَلْقٍ وَلَا يُحْتَجُّ بِحَدِيثِهِ فَقَالَ أَحْمَدُ بْنُ حَنْبَلٍ كِلَا الْأَمْرَيْنِ عَلَى مَا قُلْتُمَا فَقَالَ يَحْيَى مَالِكٌ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّهُ تَوَضَّأَ مِنْ مَسِّ الذَّكَرِ فَقَالَ عَلِيُّ كَانَ ابْنُ مَسْعُودٍ يَقُولُ لَا يَتَوَضَّأُ مِنْهُ وَإِنَّمَا هُوَ بَضْعَةٌ مِنْ جَسَدِكَ فَقَالَ يَحْيَى عَنْ مَنْ قَالَ سُفْيَانُ عَنْ أَبِي قَيْسٍ عَنْ هُزَيْلٍ عَنْ عَبْدِ اللَّهِ وَإِذَا اجْتَمَعَ ابْنُ مَسْعُودٍ وَابْنُ عُمَرَ وَاخْتَلَفَا فَابْنُ مَسْعُودٍ أَوْلَى أَنْ يُتَّبَعَ فَقَالَ لَهُ أَحْمَدُ نَعَمْ وَلَكِنْ أَبُو قَيْسٍ لَا يُحْتَجُّ بِحَدِيثِهِفَقَالَ حَدَّثَنِي أَبُو نُعَيْمٍ ثنا مِسْعَرٌ عَنْ عُمَيْرِ بْنِ سَعِيدٍ عَنْ عَمَّارِ بْنِ يَاسِرٍ قَالَ مَا أُبَالِي مَسِسْتُهُ أَوْ أَنْفِي فَقَالَ أَحْمَدُ عَمَّارٌ وَابْنُ عُمَرَ اسْتَوَيَا فَمَنْ شَاءَ أَخَذَ بِهَذَا وَمَنْ شَاءَ أَخَذَ بِهَذَا

Translation

✧ He said: We gathered in the mosque of al-Khayf: I, Ahmad b. Hanbal, Ali b. al-Madini, and Yahya b. Ma'in. They debated about touching the penis. Yahya said: Wudu is required because of it. Ali b. al-Madini held the view of the Kufans and adopted their position. Yahya b. Ma'in cited as evidence the hadith of Busrah bt. Safwan, while Ali b. al-Madini cited the hadith of Qays b. Talq. He said to Yahya: How can you rely on the chain of Busrah when Marwan sent a guard to bring her answer back to him? Yahya replied: People have said much about Qays b. Talq, and his hadith cannot be used as evidence. Ahmad b. Hanbal said: Both positions are as you two have stated. Yahya said: Malik, from Nafi', from Ibn Umar, that he performed wudu after touching the penis. Ali said: Ibn Mas'ud used to say: Wudu is not required because of it; it is only a piece of your body. Yahya said: From whom? He said: Sufyan, from Abu Qays, from Hudhayl, from Abdullah. When Ibn Mas'ud and Ibn Umar are brought together and they differ, Ibn Mas'ud is more deserving of being followed. Ahmad said to him: Yes, but Abu Qays's hadith cannot be used as evidence. He said: Abu Nu'aym narrated to me: Mis'ar narrated to us, from Umayr b. Sa'id, from Ammar b. Yasir, who said: I do not care whether I touched it or my nose. Ahmad said: Ammar and Ibn Umar are equal. Whoever wishes may take this position, and whoever wishes may take that position.
