نا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْحَسَنِ الصَّوَّافُ نا حَامِدُ بْنُ شُعَيْبٍ نا سُرَيْجُ بْنُ يُونُسَ نا يَعْقُوبُ بْنُ إِبْرَاهِيمَ هُوَ أَبُو يُوسُفَ الْقَاضِي نا هِشَامُ بْنُ عُرْوَةَ عَنْ أَبِيهِ

أَنَّ عَبْدَ اللَّهِ بْنَ جَعْفَرٍ أَتَى الزُّبَيْرَ فَقَالَ إِنِّي اشْتَرَيْتُ بَيْعَ كَذَا وَكَذَا وَإِنَّ عَلِيًّا يُرِيدُ أَنْ يَأْتِيَ أَمِيرَ الْمُؤْمِنِينَ فَيَسْأَلَهُ أَنْ يَحْجُرَ عَلَيَّ فِيهِ فَقَالَ الزُّبَيْرُ فَأَنَا شَرِيكُكَ فِي الْبَيْعِ فَأَتَى عَلِيُّ عُثْمَانَ فَقَالَ إِنَّ ابْنَ جَعْفَرٍ اشْتَرَى بَيْعَ كَذَا وَكَذَا فَاحْجُرْ عَلَيْهِ فَقَالَ الزُّبَيْرُ أَنَا شَرِيكُهُ فِي الْبَيْعِ فَقَالَ عُثْمَانُ كَيْفَ أَحْجُرُ عَلَى رَجُلٍ فِي بَيْعٍ شَرِيكُهُ فِيهِ الزُّبَيْرُ قَالَ يَعْقُوبُ أنا آخُذُ بِالْحَجْرِ وَأُرَاهُ وَأَحْجُرُ وَأُبْطِلُ بَيْعَ الْمَحْجُورِ عَلَيْهِ وَشِرَاءَهُ وَإِذَا اشْتَرَى أَوْ بَاعَ قَبْلَ الْحَجْرِ فَإِنْ كَانَ صَلَاحًا أَجَزْتُهُ وَإِنْ كَانَ مَعْنًى يَسْتَحِقُّ الْحَجْرَ حَجَرْتُ عَلَيْهِ وَرَدَدْتُ عَلَيْهِ بَيْعَهُ وَإِنْ كَانَ مِمَّنْ لَا يَسْتَحِقُّ الْحَجْرَ عَلَيْهِ أَجَزْتُ بَيْعَهُ قَالَ يَعْقُوبُ بْنُ إِبْرَاهِيمَ وَكَانَ أَبُو حَنِيفَةَ لَا يَحْجُرُ وَلَا يَأْخُذُ بِالْحَجْرِ

✧ Abd Allah b. Ja'far came to al-Zubayr and said, "I bought such-and-such a sale, and 'Ali wants to go to the Commander of the Faithful to ask him to place me under interdiction concerning it." Al-Zubayr said, "Then I am your partner in the sale." 'Ali then came to 'Uthman and said, "Ibn Ja'far bought such-and-such a sale, so place him under interdiction." Al-Zubayr said, "I am his partner in the sale." 'Uthman said, "How can I place a man under interdiction in a sale in which al-Zubayr is his partner?" Ya'qub said: I adhere to interdiction and consider it valid; I place under interdiction and invalidate the sale and purchase of the one interdicted. If he buys or sells before interdiction, then if it is sound I allow it, and if there is a reason that warrants interdiction I place him under interdiction and reject his sale. If he is not someone who warrants interdiction, I allow his sale. Ya'qub b. Ibrahim said: Abu Hanifa would not place under interdiction and did not adhere to interdiction.
