نا عَلِيُّ بْنُ مُحَمَّدِ بْنِ أَحْمَدَ الْمِصْرِيُّ نا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ سَعِيدِ بْنِ أَبِي مَرْيَمَ نا مُحَمَّدُ بْنُ يُوسُفَ الْفِرْيَابِيُّ نا سُفْيَانُ الثَّوْرِيُّ عَنِ ابْنِ عَوْنٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ قَالَ أَصَبْتُ أَرْضًا مِنْ

أَرْضِ خَيْبَرَ مَا أَصَبْتُ مَالًا قَطُّ أَنْفَسَ عِنْدِي مِنْهُ فَأَتَيْتُ رَسُولَ اللَّهِ ﷺ أَسْتَأْمِرُهُ فَقُلْتُ يَا رَسُولَ اللَّهِ إِنِّي أَصَبْتُ مَالًا مِنْ خَيْبَرَ مَا أَصَبْتُ مَالًا أَنْفَسَ عِنْدِي مِنْهُ فَقَالَ إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا فَتَصَدَّقَ بِهَا عُمَرُ عَلَى أَنْ لَا يُبَاعَ وَلَا يُوهَبَ وَلَا يُورَثَ فَتَصَدَّقَ بِهَا عُمَرُ فِي الْفُقَرَاءِ وَفِي الْأَقْرَبِينَ وَفِي سَبِيلِ اللَّهِ وَفِي الرِّقَابِ وَابْنِ السَّبِيلِ وَالضَّيْفِ لَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ وَيُعْطِيَ بِالْمَعْرُوفِ صَدِيقًا غَيْرَ مُتَمَوِّلٍ قَالَ ابْنُ عَوْنٍ فَذَكَرْتُهُ لِابْنِ سِيرِينَ فَقَالَ غَيْرَ مُتَأَثِّلٍ مَالًا تَابَعَهُ أَبُو إِسْحَاقَ الْفَزَارِيُّ عَنِ ابْنِ عَوْنٍ
