نا أَبُو طَاهِرٍ الْقَاضِي مُحَمَّدُ بْنُ أَحْمَدَ نا مُحَمَّدُ بْنُ يَحْيَى بْنِ سُلَيْمَانَ نا أَبُو طَالِبٍ عَبْدُ الْجَبَّارِ بْنُ عَاصِمٍ حَدَّثَنِي عُبَيْدُ اللَّهِ بْنُ عَمْرٍو عَنْ عَبْدِ الْمَلِكِ بْنِ عِقَابٍ وَأَبِي حَنِيفَةَ عَنْ سِمَاكِ بْنِ حَرْبٍ قَالَ جَاءَ رَجُلٌ إِلَى عَلِيٍّ عَلَيْهِ السَّلَامُ فَقَالَ امْرَأَةٌ أَنَا وَلِيُّهَا تَزَوَّجَتْ بِغَيْرِ إِذْنِي

فَقَالَ عَلِيُّ عَلَيْهِ السَّلَامُ تَنْظُرُ فِيمَا صَنَعَتْ إِذَا كَانَتْ تَزَوَّجَتْ كُفُؤًا أَجَزْنَا ذَلِكَ لَهَا وَإِنْ كَانَتْ تَزَوَّجَتْ مَنْ لَيْسَ لَهَا بِكُفُؤٍ جَعَلْنَا ذَلِكَ إِلَيْكَ
