ثنا أَبُو مُحَمَّدِ بْنُ صَاعِدٍ نا عَبْدُ اللَّهِ بْنُ عَبْدِ السَّلَامِ أَبُو الرَّدَادِ نا وَهْبُ اللَّهِ بْنُ رَاشِدٍ نا يُونُسُ بْنُ يَزِيدَ ح وثنا الْحَسَنُ بْنُ رَشِيقٍ بِمِصْرَ نا الْعَبَّاسُ بْنُ مُحَمَّدِ بْنِ الْعَبَّاسِ الْبَصْرِيُّ ح وثنا مُحَمَّدُ بْنُ يَحْيَى بْنِ مِرْدَاسٍ نا أَبُو دَاوُدَ قَالَا نا أَحْمَدُ بْنُ صَالِحٍ نا عَنْبَسَةُ بْنُ خَالِدٍ حَدَّثَنِي يُونُسُ قَالَ

سَأَلْتُ أَبَا الزِّنَادِ عَنْ بَيْعِ الثَّمَرِ قَبْلَ أَنْ يَبْدُوَ صَلَاحُهُ وَمَا ذُكِرَ فِي ذَلِكَ فَقَالَ كَانَ عُرْوَةُ بْنُ الزُّبَيْرِ يُحَدِّثُ عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ عَنْ زَيْدِ بْنِ ثَابِتٍ قَالَ كَانَ النَّاسُ يَتَبَايَعُونَ الثَّمَرَ قَبْلَ أَنْ يَبْدُوَ صَلَاحُهَا فَإِذَا جَدَّ النَّاسُ وَحَضَرَ تَقَاضِيهِمْ قَالَ الْمُبْتَاعُ قَدْ أَصَابَ الثِّمَارَ الدُّمَانُ وَأَصَابَهُ قُشَامٌ وَأَصَابَهُ مُرَاضٌ عَاهَاتٌ يَحْتَجُّونَ بِهَا فَلَمَّا كَثُرَتْ خُصُومُهُمْ عِنْدَ النَّبِيِّ ﷺ قَالَ رَسُولُ اللَّهِ ﷺ كَالْمَشُورَةِ يُشِيرُ بِهَا أَمَا لَا فَلَا تَبْتَاعُوا الثَّمَرَ حَتَّى تَبْدُوَ صَلَاحُهَا لِكَثْرَةِ خُصُومَتِهِمْ وَاخْتِلَافِهِمْ اللَّفْظُ لِعَنْبَسَةَ وَقَالَ أَبُو الرَّدَّادِ أَصَابَ الثَّمَرُ مَرَاقٌّ وَأَصَابَهُ قُشَامٌ
