حَدَّثَنَا الْحَسَنُ بْنُ مُحَمَّدٍ الزَّعْفَرَانِيُّ، قَالَ: نَا سَعِيدُ بْنُ سُلَيْمَانَ، قَالَ: نَا عَبَّادُ بْنُ الْعَوَّامِ عَنْ سُفْيَانَ بْنِ حُسَيْنٍ عَنِ الْحَكَمِ عَنْ مُجَاهِدٍ، عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ:

لَمَّا نَزَلَتْ هَذِهِ الْآيَةُ: فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ، قَالَ: فَكَانَ مُخَيَّرًا إِنْ شَاءَ حَكَمَ، وَإِنْ شَاءَ أَعْرَضَ عَنْهُمْ وَرَدَّهُمْ إِلَى أَحْكَامِهِمْ قَالَ: فَنَزَلَتْ: وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْـزَلَ اللهُ وَلا تَتَّبِعْ أَهْوَاءَهُمْ، قَالَ: فَأُمِرَ أَنْ يَحْكُمَ بَيْنَهُمْ بِمَا فِي كِتَابِنَا

✧ When this verse was revealed: 'So judge between them or turn away from them,' he said: He was given a choice: if he wished, he could judge; and if he wished, he could turn away from them and refer them back to their own laws. He said: Then it was revealed: 'And judge between them by what Allah has sent down, and do not follow their whims.' He said: So he was commanded to judge between them by what is in our Book.
