أَخْبَرَنَا ) أَبُو عَبْدِ اللهِ الْحَافِظُ، ثَنَا أَبُو الْعَبَّاسِ: مُحَمَّدُ بْنُ يَعْقُوبَ، ثَنَا يَحْيَى بْنُ أَبِي طَالِبٍ، أَنْبَأَ يَزِيدُ بْنُ هَارُونَ، أَنْبَأَ الْحَجَّاجُ بْنُ أَرْطَاةَ عَنْ وَبَرَةَ قَالَ:
كَانَ شُرَيْحٌ يَقْضِي فِي الْعَبْدِ إِذَا تَزَوَّجَ الْحُرَّةَ فَوَلَدَتْ لَهُ أَوْلَادًا أَنَّ الْوَلَاءَ لِأُمِّهِمْ فَقِيلَ لَهُ: إِنَّ عُمَرَ ؓ قَضَى أَنَّ الْأَبَ إِذَا أُعْتِقَ جَرَّ الْوَلَاءَ فَتَرَكَ شُرَيْحٌ ذَلِكَ
