( وَأَخْبَرَنَا ) أَبُو طَاهِرٍ الْفَقِيهُ، ثَنَا أَبُو الْعَبَّاسِ أَحْمَدُ بْنُ هَارُونَ الْفَقِيهُ، ثَنَا بِشْرُ بْنُ مُوسَى، ثَنَا الْمُقْرِي، ثَنَا أَبُو حَنِيفَةَ، عَنِ الْهَيْثَمِ - وَكَانَ صَيْرَفِيًّا بِالْكُوفَةِ - عَنْ أَنَسِ بْنِ سِيرِينَ أَخِي مُحَمَّدِ بْنِ سِيرِينَ قَالَ:

جَعَلَ عُمَرُ بْنُ الْخَطَّابِ ؓ أَنَسَ بْنَ مَالِكٍ عَلَى صَدَقَةِ الْبَصْرَةِ، فَقَالَ لِي أَنَسُ بْنُ مَالِكٍ: أَبْعَثُكَ عَلَى مَا بَعَثَنِي عَلَيْهِ عُمَرُ بْنُ الْخَطَّابِ ؓ فَقُلْتُ: لَا أَعْمَلُ لَكَ حَتَّى تَكْتُبَ لِي عَهْدَ عُمَرَ بْنِ الْخَطَّابِ الَّذِي عَهِدَ إِلَيْكَ، فَكَتَبَ لِي أَنْ خُذْ مِنْ أَمْوَالِ الْمُسْلِمِينَ رُبُعَ الْعُشْرِ، وَمِنْ أَمْوَالِ أَهْلِ الذِّمَّةِ إِذَا اخْتَلَفُوا لِلتِّجَارَةِ نِصْفَ الْعُشْرِ، وَمِنْ أَمْوَالِ أَهْلِ الْحَرْبِ الْعُشْرَ
