ʿUmar b. al-Khaṭṭāb (may God be pleased with him) was brought a man whose hand and foot had been cut off, who had stolen. ʿUmar (may God be pleased with him) ordered that his foot be cut off. ʿAlī (may God be pleased with him) said: "God, Mighty and Majestic, only said: {إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ} to the end of the verse. You have already cut off this man's hand and his foot, so it is not right that you cut off his foot and leave him with no leg to walk on. Either discipline him with a discretionary punishment (taʿzīr), or put him in prison." He said: So he put him in prison.

What scholars said about it

In their own words, as Hadith Unlocked records them. They are shown, not summarised into a grade.

  • Abū Bakr Aḥmad b. al-Ḥusayn al-Bayhaqī

machine translationThe first report from ʿUmar (may God be pleased with him) is more deserving to be sound. How could this one be sound from ʿUmar (may God be pleased with him), when in the first report he objected to cutting off the foot after the hand and foot, and indicated the hand? The connected (mawṣūl) report of Ibn ʿAbbās testifies to the soundness of the first report. Likewise the report of Ṣafiyyah bt. Abī ʿUbayd contains what is in the report of al-Qāsim b. Muḥammad b. Abī Bakr.
