أَخْبَرَنَا ) أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثَنَا أَبُو الْعَبَّاسِ: مُحَمَّدُ بْنُ يَعْقُوبَ، أَنْبَأَ الرَّبِيعُ بْنُ سُلَيْمَانَ، أَنْبَأَ الشَّافِعِيُّ، أَنْبَأَ مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، وَعِرَاكِ بْنِ مَالِكٍ:

أَنَّ رَجُلًا مِنْ بَنِي سَعْدِ بْنِ لَيْثٍ أَجْرَى فَرَسًا، فَوَطِئَ عَلَى أُصْبُعِ رَجُلٍ مِنْ جُهَيْنَةَ، فَنُزِيَ مِنْهَا، فَمَاتَ، فَقَالَ عُمَرُ بْنُ الْخَطَّابِ ؓ لِلَّذِينَ ادَّعَى عَلَيْهِمْ: أَتَحْلِفُونَ بِاللهِ خَمْسِينَ يَمِينًا مَا مَاتَ مِنْهَا ؟ فَأَبَوْا، وَتَحَرَّجُوا مِنَ الْأَيْمَانِ، فَقَالَ لِلْآخَرِينَ: احْلِفُوا أَنْتُمْ، فَأَبَوْا فَقَضَى عُمَرُ بْنُ الْخَطَّابِ ؓ بِشَطْرِ الدِّيَةِ عَلَى السَّعْدِيِّينَ
