( أَخْبَرَنَا ) أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، نَا أَبُو الْعَبَّاسِ الْأَصَمُّ، ثَنَا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ، نَا أَبُو أُسَامَةَ عَنْ زَائِدَةَ بْنِ قُدَامَةَ، ثَنَا سِمَاكٌ عَنْ حَنَشٍ قَالَ: قَالَ عَلِيٌّ ؓ:
لَيْسَ الَّذِي قَالَ عُمَرُ ؓ بِشَيْءٍ يَعْنِي فِي امْرَأَةِ الْمَفْقُودِ هِيَ امْرَأَةُ الْغَائِبِ حَتَّى يَأْتِيَهَا يَقِينُ مَوْتِهِ أَوْ طَلَاقُهَا وَلَهَا الصَّدَاقُ مِنْ هَذَا بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَنِكَاحُهُ بَاطِلٌ
