al-Sunan al-Kubra (al-Bayhaqi) 15317

✧ Whoever says the one who takes an oath of continence is waited for after four months; if he returns, otherwise he divorces

وَأَخْبَرَنَا ) الْفَقِيهُ أَبُو الْفَتْحِ، أَنَا الشُّرَيْحِيُّ، أَنَا أَبُو الْقَاسِمِ الْبَغَوِيُّ، نَا عَلِيُّ بْنُ الْجَعْدِ، أَنَا هُشَيْمٌ عَنِ الشَّيْبَانِيِّ عَنْ بُكَيْرِ بْنِ الْأَخْنَسِ عَنْ مُجَاهِدٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى قَالَ:

شَهِدْتُ عَلِيًّا ؓ أَوْقَفَ رَجُلًا عِنْدَ الْأَرْبَعَةِ أَشْهُرٍ قَالَ: فَوَقَفَهُ فِي الرَّحْبَةِ إِمَّا أَنْ يَفِيءَ وَإِمَّا أَنْ يُطَلِّقَ
