أَخْبَرَنَا ) أَبُو نَصْرِ بْنُ قَتَادَةَ، أَنْبَأَ أَبُو مَنْصُورٍ الْعَبَّاسُ بْنُ الْفَضْلِ الْهَرَوِيُّ، أَنْبَأَ أَحْمَدُ بْنُ نَجْدَةَ قَالَ: ثَنَا سَعِيدُ بْنُ مَنْصُورٍ، ثَنَا جَرِيرٌ عَنْ مُغِيرَةَ، عَنِ الشَّعْبِيِّ قَالَ:

تَزَوَّجَ رَجُلٌ مِنَّا امْرَأَةً فَطَلَّقَهَا زَوْجُهَا قَبْلَ أَنْ يَدْخُلَ بِهَا فَعَفَا أَخُوهَا عَنْ صَدَاقِهَا، فَارْتَفَعُوا إِلَى شُرَيْحٍ فَأَجَازَ عَفْوَهُ ثُمَّ قَالَ بَعْدُ: أَنَا أَعْفُو عَنْ صَدَاقِ بَنِيَّ مُرَّةَ فَكَانَ يَقُولُ بَعْدُ: الَّذِي بِيَدِهِ عُقْدَةُ النِّكَاحِ الزَّوْجُ أَنْ يَعْفُوَ عَنِ الصَّدَاقِ كُلِّهِ فَيُسَلِّمَهُ إِلَيْهَا، أَوْ تَعْفُوَ هِيَ عَنِ النِّصْفِ الَّذِي فَرَضَ اللهُ لَهَا، وَإِنْ تَشَاحَّا فَلَهَا نِصْفُ الصَّدَاقِ
