أَخْبَرَنَا ) أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِي، أَنَا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ، ثَنَا يُوسُفُ بْنُ يَعْقُوبَ، ثَنَا مُحَمَّدُ بْنُ أَبِي بَكْرٍ، ثَنَا فُضَيْلُ بْنُ سُلَيْمَانَ، ثَنَا مُوسَى بْنُ عُقْبَةَ بْنِ أَبِي عَيَّاشٍ الْأَسَدِيُّ قَالَ: حَدَّثَنِي إِسْحَاقُ بْنُ يَحْيَى بْنِ الْوَلِيدِ بْنِ عُبَادَةَ بْنِ الصَّامِتِ عَنْ عُبَادَةَ بْنِ الصَّامِتِ ؓ قَالَ:

إِنَّ مِنْ قَضَاءِ رَسُولِ اللهِ ﷺ أَنَّ ثَمَرَ النَّخْلِ لِمَنْ أَبَّرَهَا، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ، وَأَنَّ مَالَ الْمَمْلُوكِ لِمَنْ بَاعَهُ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
