حَدَّثَنَا إِسْمَاعِيلُ حَدَّثَنَا أَيُّوبُ عَنْ نَافِعٍ

أَرَادَ ابْنُ مَعْمَرٍ أَنْ يُنْكِحَ ابْنَهُ ابْنَةَ شَيْبَةَ بْنِ جُبَيْرٍ، فَبَعَثَنِي إِلَى أَبَانَ بْنِ عُثْمَانَ وَهُوَ أَمِيرُ الْمَوْسِمِ، فَأَتَيْتُهُ فَقُلْتُ لَهُ: إِنَّ أَخَاكَ أَرَادَ أَنْ يُنْكِحَ ابْنَهُ فَأَرَادَ أَنْ يُشْهِدَكَ ذَاكَ، فَقَالَ: أَلَا أُرَاهُ عِرَاقِيًّا جَافِيًا إِنَّ الْمُحْرِمَ لَا يَنْكِحُ، وَلَا يُنْكِحُ، ثُمَّ حَدَّثَ عَنْ عُثْمَانَ بِمِثْلِهِ يَرْفَعُهُ

Translation

✧ Ibn Ma'mar wanted to marry his son to the daughter of Shaybah b. Jubayr, so he sent me to Aban b. Uthman, who was the governor of the pilgrimage season. I went to him and said: 'Your brother wants to marry his son and wanted you to witness it.' He said: 'Do I not see him as a coarse Iraqi? A person in ihram may not marry or arrange a marriage.' Then he narrated from Uthman something similar, tracing it back to the Prophet.
