حَدَّثَنَا مُحَمَّدُ بْنُ يَزِيدَ يَعْنِي الْوَاسِطِيَّ عَنْ سُفْيَانَ يَعْنِي ابْنَ حُسَيْنٍ عَنْ الزُّهْرِيِّ عَنْ سَالِمٍعَنْ أَبِيهِ قَالَ

كَانَ رَسُولُ اللهِ ﷺ قَدْ كَتَبَ الصَّدَقَةَ وَلَمْ يُخْرِجْهَا إِلَى عُمَّالِهِ حَتَّى تُوُفِّيَ. قَالَ: فَأَخْرَجَهَا أَبُو بَكْرٍ مِنْ بَعْدِهِ فَعَمِلَ بِهَا حَتَّى تُوُفِّيَ، ثُمَّ أَخْرَجَهَا عُمَرُ مِنْ بَعْدِهِ فَعَمِلَ بِهَا. قَالَ: فَلَقَدْ هَلَكَ عُمَرُ يَوْمَ هَلَكَ وَإِنَّ ذَلِكَ لَمَقْرُونٌ بِوَصِيَّتِهِ. فَقَالَ: كَانَ فِيهَا: فِي الْإِبِلِ فِي كُلِّ خَمْسٍ شَاةٌ حَتَّى تَنْتَهِيَ إِلَى أَرْبَعٍ وَعِشْرِينَ، فَإِذَا بَلَغَتْ إِلَى خَمْسٍ وَعِشْرِينَ فَفِيهَا بِنْتُ مَخَاضٍ إِلَى خَمْسٍ وَثَلَاثِينَ، فَإِنْ لَمْ تَكُنِ ابْنَةُ مَخَاضٍ فَابْنُ لَبُونٍ. فَإِذَا زَادَتْ عَلَى خَمْسٍ وَثَلَاثِينَ فَفِيهَا ابْنَةُ لَبُونٍ إِلَى خَمْسٍ وَأَرْبَعِينَ، فَإِذَا زَادَتْ وَاحِدَةً فَفِيهَا حِقَّةٌ إِلَى سِتِّينَ، فَإِذَا زَادَتْ فَفِيهَا جَذَعَةٌ إِلَى خَمْسٍ وَسَبْعِينَ، فَإِذَا زَادَتْ فَفِيهَا ابْنَتَا لَبُونٍ إِلَى تِسْعِينَ، فَإِذَا زَادَتْ فَفِيهَا حِقَّتَانِ إِلَى عِشْرِينَ وَمِائَةٍ، فَإِذَا كَثُرَتِ الْإِبِلُ فَفِي كُلِّ خَمْسِينَ حِقَّةٌ، وَفِي كُلِّ أَرْبَعِينَ ابْنَةُ لَبُونٍ، وَفِي الْغَنَمِ مِنْ أَرْبَعِينَ شَاةٌ إِلَى عِشْرِينَ وَمِائَةٍ، فَإِذَا زَادَتْ فَفِيهَا شَاتَانِ إِلَى مِائَتَيْنِ، فَإِذَا زَادَتْ فَفِيهَا ثَلَاثٌ إِلَى ثَلَاثِمِائَةٍ، فَإِذَا زَادَتْ بَعْدُ فَلَيْسَ فِيهَا شَيْءٌ حَتَّى تَبْلُغَ أَرْبَعَمِائَةٍ، فَإِذَا كَثُرَتِ الْغَنَمُ فَفِي كُلِّ مِائَةٍ شَاةٌ. وَكَذَلِكَ لَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ مَخَافَةَ الصَّدَقَةِ. وَمَا كَانَ مِنْ خَلِيطَيْنِ فَهُمَا يَتَرَاجَعَانِ بِالسَّوِيَّةِ، لَا تُؤْخَذُ هَرِمَةٌ وَلَا ذَاتُ عَيْبٍ مِنَ الْغَنَمِ.

✧ The Messenger of Allah ﷺ had written the zakat document and did not send it out to his agents until he passed away. He said: Then Abu Bakr brought it out after him and acted according to it until he passed away, then Umar brought it out after him and acted according to it. He said: When Umar died on the day he died, that was attached to his will. He said: In it was: for camels, for every five, one sheep, up to twenty-four. When they reach twenty-five, there is a bint makhad up to thirty-five. If there is no bint makhad, then a bint labun. When they exceed thirty-five, there is a bint labun up to forty-five. When they increase by one, there is a hiqqah up to sixty. When they increase further, there is a jadhah up to seventy-five. When they increase further, there are two bint labun up to ninety. When they increase further, there are two hiqqahs up to one hundred and twenty. When camels are numerous, for every fifty, a hiqqah, and for every forty, a bint labun. For sheep, from forty, one sheep up to one hundred and twenty. When they increase, there are two sheep up to two hundred. When they increase, there are three up to three hundred. When they increase beyond that, there is nothing until they reach four hundred. When sheep are numerous, for every hundred, one sheep. Likewise, there should be no separating between combined flocks nor combining between separated flocks out of fear of zakat. What belongs to two partners, they settle between themselves equally. No old sheep nor one with a defect should be taken from the sheep.
