✧ The daughter of Sa‘id b. Zayd b. ‘Amr b. Nufayl—and Fatimah bint Qays was her maternal aunt—had been with ‘Abd Allah b. ‘Amr b. ‘Uthman, and he divorced her three times. Her maternal aunt sent for her and moved her to her house, while Marwan b. al-Hakam was over Madinah. Qabisah said: Marwan sent me to her, and I asked her: “What prompted her to remove a woman from her house before her waiting period ended?” He said: She said: “Because the Messenger of Allah ﷺ commanded me to do that.” He said: Then she related her hadith to me, then said: “I contend with you by the Book of Allah. Allah, Mighty and Majestic, says in His Book: ‘When you divorce women, divorce them at their waiting period, and count the waiting period, and fear Allah your Lord. Do not turn them out of their houses, nor should they leave, unless they commit a clear indecency’ until: ‘Perhaps Allah will bring about after that a matter.’ Then Allah, Mighty and Majestic, said: ‘When they have reached their term, then retain them with kindness or release them with kindness.’ By Allah, Allah did not mention after the third divorce any confinement, along with what the Messenger of Allah ﷺ commanded me.” He said: I returned to Marwan and told him her report, and he said: “The hadith of a woman, the hadith of a woman.” He said: Then he ordered the woman to be returned to her house until her waiting period ended.
