حَدَّثَنَا وَكِيعٌ قَالَ حَدَّثَنَا أُسَامَةُ بْنُ زَيْدٍ عَنْ عَبْدِ اللهِ بْنِ رَافِعٍعَنْ أُمِّ سَلَمَةَ قَالَتْ

جَاءَ رَجُلَانِ مِنَ الْأَنْصَارِ يَخْتَصِمَانِ إِلَى رَسُولِ اللهِ ﷺ فِي مَوَارِيثَ بَيْنَهُمَا قَدْ دَرَسَتْ، لَيْسَ بَيْنَهُمَا بَيِّنَةٌ، فَقَالَ رَسُولُ اللهِ ﷺ: إِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ، وَإِنَّمَا أَنَا بَشَرٌ. وَلَعَلَّ بَعْضَكُمْ أَلْحَنُ بِحُجَّتِهِ - أَوْ قَدْ قَالَ: لِحُجَّتِهِ - مِنْ بَعْضٍ، فَإِنَّمَا أَقْضِي بَيْنَكُمْ عَلَى نَحْوِ مَا أَسْمَعُ، فَمَنْ قَضَيْتُ لَهُ مِنْ حَقِّ أَخِيهِ شَيْئًا فَلَا يَأْخُذْهُ، فَإِنَّمَا أَقْطَعُ لَهُ قِطْعَةً مِنَ النَّارِ يَأْتِي بِهَا إِسْطَامًا فِي عُنُقِهِ يَوْمَ الْقِيَامَةِ. فَبَكَى الرَّجُلَانِ، وَقَالَ كُلُّ وَاحِدٍ مِنْهُمَا: حَقِّي لِأَخِي. قَالَ: فَقَالَ رَسُولُ اللهِ ﷺ: أَمَا إِذْ قُلْتُمَا، فَاذْهَبَا فَاقْتَسِمَا، ثُمَّ تَوَخَّيَا الْحَقَّ، ثُمَّ اسْتَهِمَا، ثُمَّ لِيُحَلِّلْ كُلُّ وَاحِدٍ مِنْكُمَا صَاحِبَهُ

Translation

✧ Two men from the Ansar came disputing to the Messenger of Allah ﷺ over an inheritance between them that had been obliterated, with no evidence between them. The Messenger of Allah ﷺ said: 'You bring your disputes to me, and I am only a human being. Perhaps some of you is more eloquent in his argument—or he said: in presenting his argument—than others. I only judge between you according to what I hear. Whoever I judge in favor of with something from his brother's right, let him not take it, for I am only cutting off for him a piece of the Fire which he will bring as a collar around his neck on the Day of Resurrection.' The two men wept, and each of them said: 'My right is for my brother.' He said: Then the Messenger of Allah ﷺ said: 'Since you have said this, go and divide it, then aim for what is right, then draw lots, then let each of you absolve the other.'
