حَدَّثَنَا يَعْقُوبُ قَالَ حَدَّثَنَا ابْنُ أَخِي ابْنِ شِهَابٍ عَنْ عَمِّهِ قَالَ أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ أَنَّ عَائِشَةَ زَوْجَ النَّبِيِّ ﷺ أَخْبَرَتْهُ
أَنَّ بَرِيرَةَ دَخَلَتْ عَلَيْهَا تَسْتَعِينُهَا فِي كِتَابَتِهَا، فَقَالَتْ لَهَا عَائِشَةُ - وَنَفِسَتْ فِيهَا -: أَرَأَيْتِ إِنْ عَدَّتُ لِأَهْلِكِ الَّذِي عَلَيْكِ عَدَّةً وَاحِدَةً أَيَفْعَلْنَ ذَلِكَ، وَأُعْتِقُكِ فَتَكُونِي مَوْلَاتِي ؟ فَذَهَبَتْ بَرِيرَةُ إِلَى أَهْلِهَا فَعَرَضَتْ ذَلِكَ عَلَيْهِمْ فَقَالُوا: لَا، إِلَّا أَنْ يَكُونَ وَلَاؤُكِ لَنَا. قَالَتْ عَائِشَةُ: فَدَخَلَ عَلَيَّ رَسُولُ اللهِ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ، فَقَالَ رَسُولُ اللهِ ﷺ: اشْتَرِي فَأَعْتِقِي فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ، ثُمَّ قَامَ رَسُولُ اللهِ ﷺ عَشِيَّةً فَقَالَ: مَا بَالُ رِجَالٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَ فِي كِتَابِ اللهِ، أَلَا مَنِ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللهِ فَلَيْسَ لَهُ وَإِنِ اشْتَرَطَ مِائَةَ مَرَّةٍ، شَرْطُ اللهِ أَحَقُّ وَأَوْثَقُ

✧ Barirah entered upon her seeking her help regarding her kitabah (contract of manumission), so Aishah said to her — and she desired to do so: "What if I pay your masters what you owe in a single payment, would they do that, and I set you free, and you would become my mawlah?" Barirah went to her masters and presented that to them, but they said: "No, unless your wala' (patronage) belongs to us." Aishah said: "The Messenger of God ﷺ entered upon me, and I mentioned that to him. The Messenger of God ﷺ said: 'Buy her and set her free, for wala' belongs to the one who sets free.' Then the Messenger of God ﷺ stood up in the evening and said: 'What is the matter with men who stipulate conditions that are not in the Book of God? Whoever stipulates a condition that is not in the Book of God, it is not valid for him, even if he stipulates it a hundred times. God's condition is more deserving and more binding.'"
