حَدَّثَنَا مُعَاوِيَةُ بْنُ عَمْرٍو وَهَارُونُ بْنُ مَعْرُوفٍ قَالَا حَدَّثَنَا عَبْدُ اللهِ بْنُ وَهْبٍ وَقَالَ هَارُونُ فِي حَدِيثِهِ قَالَ وَقَالَ حَيْوَةُ عَنِ ابْنِ أَبِي حَبِيبٍ وَقَالَ مُعَاوِيَةُ عَنْ حَيْوَةَ عَنْ يَزِيدَ عَنْ سَلَمَةَ بْنِ أُسَامَةَ عَنْ يَحْيَى بْنِ الْحَكَمِ أَنَّ مُعَاذًا قَالَ

بَعَثَنِي رَسُولُ اللهِ ﷺ أُصَدِّقُ أَهْلَ الْيَمَنِ، وَأَمَرَنِي أَنْ آخُذَ مِنَ الْبَقَرِ مِنْ كُلِّ ثَلَاثِينَ تَبِيعًا. قَالَ هَارُونُ: وَالتَّبِيعُ الْجَذَعُ أَوِ الْجَذَعَةُ. وَمِنْ كُلِّ أَرْبَعِينَ مُسِنَّةً. قَالَ: فَعَرَضُوا عَلَيَّ أَنْ آخُذَ مِنَ الْأَرْبَعِينَ. - قَالَ هَارُونُ: مَا بَيْنَ الْأَرْبَعِينَ - وَالْخَمْسِينَ، وَبَيْنَ السِّتِّينَ وَالسَّبْعِينَ، وَمَا بَيْنَ الثَّمَانِينَ وَالتِّسْعِينَ. فَأَبَيْتُ ذَاكَ وَقُلْتُ لَهُمْ: حَتَّى أَسْأَلَ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ، فَقَدِمْتُ فَأَخْبَرْتُ النَّبِيَّ ﷺ، فَأَمَرَنِي أَنْ آخُذَ مِنْ كُلِّ ثَلَاثِينَ تَبِيعًا، وَمِنْ كُلِّ أَرْبَعِينَ مُسِنَّةً، وَمِنَ السِّتِّينَ تَبِيعَيْنِ، وَمِنَ السَّبْعِينَ مُسِنَّةً وَتَبِيعًا، وَمِنَ الثَّمَانِينَ مُسِنَّتَيْنِ، وَمِنَ التِّسْعِينَ ثَلَاثَةَ أَتْبَاعٍ، وَمِنَ الْمِائَةِ مُسِنَّةً وَتَبِيعَيْنِ، وَمِنَ الْعَشَرَةِ وَالْمِائَةِ مُسِنَّتَيْنِ وَتَبِيعًا، وَمِنَ الْعِشْرِينَ وَمِائَةٍ ثَلَاثَ مُسِنَّاتٍ أَوْ أَرْبَعَةَ أَتْبَاعٍ. قَالَ: وَأَمَرَنِي رَسُولُ اللهِ ﷺ أَنْ لَا آخُذَ فِيمَا بَيْنَ ذَلِكَ وَقَالَ هَارُونُ: فِيمَا بَيْنَ ذَلِكَ شَيْئًا إِلَّا أَنْ يَبْلُغَ مُسِنَّةً أَوْ جَذَعًا. وَزَعَمَ أَنَّ الْأَوْقَاصَ لَا فَرِيضَةَ فِيهَا.

✧ The Messenger of God ﷺ sent me to collect zakat from the people of Yemen, and commanded me to take from cattle: for every thirty, a tabi'. Harun said: 'The tabi' is the jadha' — male or female.' And for every forty, a musinnah. He said: 'They offered me to take from the fortieth —' Harun said: 'what is between forty —' and fifty, and between sixty and seventy, and what is between eighty and ninety. I refused that and said to them: 'Until I ask the Messenger of God ﷺ about that.' So I came and informed the Prophet ﷺ, and he commanded me to take from every thirty a tabi', from every forty a musinnah, from sixty two tabi's, from seventy a musinnah and a tabi', from eighty two musinnahs, from ninety three tabi's, from one hundred a musinnah and two tabi's, from one hundred ten two musinnahs and a tabi', and from one hundred twenty three musinnahs or four tabi's.' He said: 'And the Messenger of God ﷺ commanded me not to take anything for what is between that.' And Harun said: 'for what is between that, nothing, unless it reaches a musinnah or a jadha'.' And he asserted that the awaqas have no obligatory duty in them.
