حَدَّثَنَا وَكِيعٌ حَدَّثَنَا هِشَامُ بْنُ سَعْدٍ أَخْبَرَنِي يَزِيدُ بْنُ نُعَيْمِ بنِ هَزَّالٍ عَنْ أَبِيهِ قَالَ

كَانَ مَاعِزُ بْنُ مَالِكٍ فِي حِجْرِ أَبِي، فَأَصَابَ جَارِيَةً مِنَ الْحَيِّ، فَقَالَ لَهُ أَبِي: ائْتِ رَسُولَ اللهِ ﷺ فَأَخْبِرْهُ بِمَا صَنَعْتَ لَعَلَّهُ يَسْتَغْفِرُ لَكَ، وَإِنَّمَا يُرِيدُ بِذَلِكَ رَجَاءَ أَنْ يَكُونَ لَهُ مَخْرَجٌ. فَأَتَاهُ فَقَالَ: يَا رَسُولَ اللهِ، إِنِّي زَنَيْتُ فَأَقِمْ عَلَيَّ كِتَابَ اللهِ، فَأَعْرَضَ عَنْهُ فَعَادَ فَقَالَ: يَا رَسُولَ اللهِ، إِنِّي زَنَيْتُ فَأَقِمْ عَلَيَّ كِتَابَ اللهِ، [فَأَعْرَضَ عَنْهُ] ثُمَّ أَتَاهُ الثَّالِثَةَ فَقَالَ: يَا رَسُولَ اللهِ، إِنِّي زَنَيْتُ فَأَقِمْ عَلَيَّ كِتَابَ اللهِ، ثُمَّ أَتَاهُ الرَّابِعَةَ فَقَالَ: يَا رَسُولَ اللهِ، إِنِّي زَنَيْتُ فَأَقِمْ عَلَيَّ كِتَابَ اللهِ. فَقَالَ رَسُولُ اللهِ ﷺ: إِنَّكَ قَدْ قُلْتَهَا أَرْبَعَ مَرَّاتٍ، فَبِمَنْ ؟ قَالَ: بِفُلَانَةَ. قَالَ: هَلْ ضَاجَعْتَهَا ؟ قَالَ: نَعَمْ. قَالَ: هَلْ بَاشَرْتَهَا ؟ قَالَ: نَعَمْ. قَالَ: هَلْ جَامَعْتَهَا ؟ قَالَ: نَعَمْ. قَالَ: فَأَمَرَ بِهِ أَنْ يُرْجَمَ. قَالَ: فَأُخْرِجَ بِهِ إِلَى الْحَرَّةِ، فَلَمَّا رُجِمَ فَوَجَدَ مَسَّ الْحِجَارَةِ جَزِعَ فَخَرَجَ يَشْتَدُّ، فَلَقِيَهُ عَبْدُ اللهِ بْنُ أُنَيْسٍ وَقَدْ أَعْجَزَ أَصْحَابَهُ، فَنَزَعَ لَهُ بِوَظِيفِ بَعِيرٍ فَرَمَاهُ بِهِ فَقَتَلَهُ. قَالَ: ثُمَّ أَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ: هَلَّا تَرَكْتُمُوهُ لَعَلَّهُ يَتُوبُ فَيَتُوبَ اللهُ عَلَيْهِ ؟ قَالَ هِشَامٌ: فَحَدَّثَنِي يَزِيدُ بْنُ نُعَيْمِ بْنِ هَزَّالٍ، عَنْ أَبِيهِ، أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِأَبِي حِينَ رَآهُ: وَاللهِ يَا هَزَّالُ، لَوْ كُنْتَ سَتَرْتَهُ بِثَوْبِكَ كَانَ أَخْيَرَ مِمَّا صَنَعْتَ بِهِ

✧ Ma'iz b. Malik was under the care of my father, and he had intercourse with a slave girl of the tribe. My father said to him: 'Go to the Messenger of Allah ﷺ and tell him what you have done; perhaps he will seek forgiveness for you,' intending by that only the hope that there might be a way out for him. So he came to him and said: 'O Messenger of Allah, I have committed adultery, so carry out the punishment prescribed by Allah upon me.' He turned away from him, but he repeated: 'O Messenger of Allah, I have committed adultery, so carry out the punishment prescribed by Allah upon me.' He turned away from him again. Then he came to him a third time and said: 'O Messenger of Allah, I have committed adultery, so carry out the punishment prescribed by Allah upon me.' Then he came to him a fourth time and said: 'O Messenger of Allah, I have committed adultery, so carry out the punishment prescribed by Allah upon me.' The Messenger of Allah ﷺ said: 'You have said it four times. With whom?' He said: 'With so-and-so.' He said: 'Did you lie with her?' He said: 'Yes.' He said: 'Did you touch her skin to skin?' He said: 'Yes.' He said: 'Did you have intercourse with her?' He said: 'Yes.' He said: So he ordered that he be stoned. He said: He was taken out to the Harrah. When he was stoned and felt the touch of the stones, he panicked and ran off quickly. 'Abdullah b. Unays met him after he had outrun his companions, so he took the leg bone of a camel and threw it at him, killing him. He said: Then he came to the Prophet ﷺ and mentioned that to him, and he said: 'Why did you not leave him? Perhaps he would have repented and Allah would have accepted his repentance.' Hisham said: Yazid b. Nu'aym b. Hazzal narrated to me from his father that the Messenger of Allah ﷺ said to my father when he saw him: 'By Allah, O Hazzal, if you had concealed him with your garment, it would have been better for you than what you did to him.'
