حَدَّثَنَا إِسْمَاعِيلُ عَنْ يُونُسَ عَنِ الْحَسَنِ عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ
أَنَّ رَجُلًا خَرَجَ فِي غَزَاةٍ، وَمَعَهُ جَارِيَةٌ لِامْرَأَتِهِ فَوَقَعَ بِهَا، فَذُكِرَ لِلنَّبِيِّ ﷺ فَقَالَ: إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ عَتِيقَةٌ وَلَهَا عَلَيْهِ مِثْلُهَا، وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ أَمَتُهُ وَلَهَا عَلَيْهِ مِثْلُهَا
Translation

✧ A man went out on a military campaign, and with him was a slave girl belonging to his wife, and he had intercourse with her. This was mentioned to the Prophet ﷺ, and he said, "If he forced her, she is set free and he owes her the like of her; and if she willingly went along with him, then she remains his slave girl and he owes her the like of her."
