حَدَّثَنَا أَبُو مُعَاوِيَةَ حَدَّثَنَا الْأَعْمَشُ عَنْ عَبْدِ اللهِ بْنِ مُرَّةَ عَنِ الْبَرَاءِ بْنِ عَازِبٍ قَالَ
مُرَّ عَلَى رَسُولِ اللهِ ﷺ بِيَهُودِيٍّ مُحَمَّمٍ مَجْلُودٍ، فَدَعَاهُمْ فَقَالَ: أَهَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ ؟ فَقَالُوا: نَعَمْ. قَالَ: فَدَعَا رَجُلًا مِنْ عُلَمَائِهِمْ فَقَالَ: أَنْشُدُكَ بِاللهِ الَّذِي أَنْزَلَ التَّوْرَاةَ عَلَى مُوسَى، أَهَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ ؟ فَقَالَ: لَا وَاللهِ، وَلَوْلَا أَنَّكَ أَنْشَدْتَنِي بِهَذَا لَمْ أُخْبِرْكَ، نَجِدُ حَدَّ الزَّانِي فِي كِتَابِنَا الرَّجْمَ، وَلَكِنَّهُ كَثُرَ فِي أَشْرَافِنَا، فَكُنَّا إِذَا أَخَذْنَا الشَّرِيفَ تَرَكْنَاهُ، وَإِذَا أَخَذْنَا الضَّعِيفَ أَقَمْنَا عَلَيْهِ الْحَدَّ، فَقُلْنَا: تَعَالَوْا حَتَّى نَجْعَلَ شَيْئًا نُقِيمُهُ عَلَى الشَّرِيفِ وَالْوَضِيعِ، فَاجْتَمَعْنَا عَلَى التَّحْمِيمِ وَالْجَلْدِ. فَقَالَ رَسُولُ اللهِ ﷺ: اللَّهُمَّ إِنِّي أَوَّلُ مَنْ أَحْيَا أَمْرَكَ إِذْ أَمَاتُوهُ. قَالَ: فَأَمَرَ بِهِ فَرُجِمَ، فَأَنْزَلَ اللهُ عَزَّ وَجَلَّ: يَا أَيُّهَا الرَّسُولُ لا يَحْزُنْكَ الَّذِينَ يُسَارِعُونَ فِي الْكُفْرِ إِلَى قَوْلِهِ يَقُولُونَ إِنْ أُوتِيتُمْ هَذَا فَخُذُوهُ يَقُولُونَ: ائْتُوا مُحَمَّدًا، فَإِنْ أَفْتَاكُمْ بِالتَّحْمِيمِ وَالْجَلْدِ فَخُذُوهُ، وَإِنْ أَفْتَاكُمْ بِالرَّجْمِ فَاحْذَرُوا إِلَى قَوْلِهِ: وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْـزَلَ اللهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ قَالَ فِي الْيَهُودِ إِلَى قَوْلِهِ وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْـزَلَ اللهُ فَأُولَئِكَ هُمُ الظَّالِمُونَ وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْـزَلَ اللهُ فَأُولَئِكَ هُمُ الْفَاسِقُونَ قَالَ: هِيَ فِي الْكُفَّارِ كُلُّهَا

✧ A Jew who had been blackened with charcoal and flogged was brought past the Messenger of Allah ﷺ. He called them and said: Do you find the punishment of the adulterer in your Book like this? They said: Yes. He said: He called one of their scholars and said: I adjure you by Allah, who sent down the Torah upon Moses: do you find the punishment of the adulterer in your Book like this? The man said: No, by Allah. Were it not that you adjured me by this, I would not have informed you. We find the punishment of the adulterer in our Book to be stoning, but it became frequent among our nobles. When we seized a noble, we let him go, and when we seized a weak person, we carried out the punishment on him. So we said: Come, let us agree on something we can apply to noble and lowly alike. We agreed on blackening with charcoal and flogging. The Messenger of Allah ﷺ said: O Allah, I am the first to revive Your command when they killed it. He said: He ordered him, and he was stoned. Then Allah, Mighty and Majestic, sent down: 'O Messenger, let not those who hasten into disbelief grieve you' up to His saying: 'They say: If you are given this, take it.' They say: Go to Muhammad; if he gives you a ruling of blackening and flogging, accept it, and if he gives you a ruling of stoning, beware. Up to His saying: 'And whoever does not judge by what Allah has sent down—those are the disbelievers.' He said regarding the Jews, up to His saying: 'And whoever does not judge by what Allah has sent down—those are the wrongdoers,' and 'And whoever does not judge by what Allah has sent down—those are the defiantly disobedient.' He said: These verses are all about the disbelievers.
