حَدَّثَنَا يَعْقُوبُ قَالَ حَدَّثَنَا أَبِي عَنِ ابْنِ إِسْحَاقَ قَالَ حَدَّثَنِي سَعِيدُ بْنُ أَبِي سَعِيدٍ الْمَقْبُرِيُّ عَنْ أَبِي شُرَيْحٍ الْخُزَاعِيِّ قَالَ

لَمَّا بَعَثَ عَمْرُو بْنُ سَعِيدٍ إِلَى مَكَّةَ بَعْثَهُ يَغْزُو ابْنَ الزُّبَيْرِ، أَتَاهُ أَبُو شُرَيْحٍ، فَكَلَّمَهُ وَأَخْبَرَهُ بِمَا سَمِعَ مِنْ رَسُولِ اللهِ ﷺ، ثُمَّ خَرَجَ إِلَى نَادِي قَوْمِهِ، فَجَلَسَ فِيهِ، فَقُمْتُ إِلَيْهِ، فَجَلَسْتُ مَعَهُ، فَحَدَّثَ قَوْمَهُ كَمَا حَدَّثَ عَمْرَو بْنَ سَعِيدٍ مَا سَمِعَ مِنْ رَسُولِ اللهِ ﷺ، وَعَمَّا قَالَ لَهُ عَمْرُو بْنُ سَعِيدٍ قَالَ: قُلْتُ: يَا هَذَا، إِنَّا كُنَّا مَعَ رَسُولِ اللهِ ﷺ حِينَ افْتَتَحَ مَكَّةَ، فَلَمَّا كَانَ الْغَدُ مِنْ يَوْمِ الْفَتْحِ عَدَتْ خُزَاعَةُ عَلَى رَجُلٍ مِنْ هُذَيْلٍ فَقَتَلُوهُ، وَهُوَ مُشْرِكٌ، فَقَامَ رَسُولُ اللهِ ﷺ فِينَا خَطِيبًا فَقَالَ: أَيُّهَا النَّاسُ، إِنَّ اللهَ عَزَّ وَجَلَّ حَرَّمَ مَكَّةَ يَوْمَ خَلَقَ السَّمَاوَاتِ وَالْأَرْضَ، فَهِيَ حَرَامٌ مِنْ حَرَامِ اللهِ تَعَالَى إِلَى يَوْمِ الْقِيَامَةِ، لَا يَحِلُّ لِامْرِئٍ يُؤْمِنُ بِاللهِ، وَالْيَوْمِ الْآخِرِ أَنْ يَسْفِكَ فِيهَا دَمًا، وَلَا يَعْضُدَ بِهَا شَجَرًا، لَمْ تَحْلِلْ لِأَحَدٍ كَانَ قَبْلِي وَلَا تَحِلُّ لِأَحَدٍ يَكُونُ بَعْدِي، وَلَمْ تَحْلِلْ لِي إِلَّا هَذِهِ السَّاعَةَ غَضَبًا عَلَى أَهْلِهَا، أَلَا ثُمَّ قَدْ رَجَعَتْ كَحُرْمَتِهَا بِالْأَمْسِ، أَلَا فَلْيُبَلِّغِ الشَّاهِدُ مِنْكُمُ الْغَائِبَ، فَمَنْ قَالَ لَكُمْ إِنَّ رَسُولَ اللهِ ﷺ قَدْ قَاتَلَ بِهَا، فَقُولُوا: إِنَّ اللهَ عَزَّ وَجَلَّ قَدْ أَحَلَّهَا لِرَسُولِهِ وَلَمْ يُحْلِلْهَا لَكُمْ يَا مَعْشَرَ خُزَاعَةَ، ارْفَعُوا أَيْدِيَكُمْ عَنِ الْقَتْلِ فَقَدْ كَثُرَ أَنْ يَقَعَ، لَئِنْ قَتَلْتُمْ قَتِيلًا لَأَدِيَنَّهُ، فَمَنْ قُتِلَ بَعْدَ مَقَامِي هَذَا فَأَهْلُهُ بِخَيْرِ النَّظَرَيْنِ: إِنْ شَاءُوا فَدَمُ قَاتِلِهِ، وَإِنْ شَاءُوا فَعَقْلُهُ " ثُمَّ وَدَى رَسُولُ اللهِ ﷺ الرَّجُلَ الَّذِي قَتَلَتْهُ خُزَاعَةُ، فَقَالَ عَمْرُو بْنُ سَعِيدٍ لِأَبِي شُرَيْحٍ: انْصَرِفْ أَيُّهَا الشَّيْخُ، فَنَحْنُ أَعْلَمُ بِحُرْمَتِهَا مِنْكَ، إِنَّهَا لَا تَمْنَعُ سَافِكَ دَمٍ وَلَا خَالِعَ طَاعَةٍ وَلَا مَانِعَ خِزْيَةٍ، قَالَ: فَقُلْتُ: قَدْ كُنْتُ شَاهِدًا وَكُنْتَ غَائِبًا، فَقَدْ بَلَّغْتُ وَقَدْ أَمَرَنَا رَسُولُ اللهِ ﷺ أَنْ يُبَلِّغَ شَاهِدُنَا غَائِبَنَا وَقَدْ بَلَّغْتُكَ، فَأَنْتَ وَشَأْنُكَ

✧ When 'Amr b. Sa'id sent his expedition to Makkah to fight Ibn al-Zubayr, Abu Shurayh came to him and spoke to him, informing him of what he had heard from the Messenger of Allah ﷺ. Then he went out to the assembly of his people, sat there, and I went to him and sat with him. He narrated to his people as he had narrated to 'Amr b. Sa'id what he had heard from the Messenger of Allah ﷺ, and about what 'Amr b. Sa'id said to him. He said: I said: O you, we were with the Messenger of Allah ﷺ when he conquered Makkah. The next day after the conquest, Khuza'ah attacked a man from Hudhayl and killed him while he was a polytheist. The Messenger of Allah ﷺ stood among us as a preacher and said: 'O people, indeed Allah, Mighty and Majestic, made Makkah sacred on the day He created the heavens and the earth, so it is sacred by the sanctity of Allah, Exalted be He, until the Day of Resurrection. It is not lawful for anyone who believes in Allah and the Last Day to shed blood in it or to cut down a tree in it. It was not made lawful for anyone before me, nor will it be made lawful for anyone after me. It was only made lawful for me for this hour out of anger against its people. Indeed, then it has returned to its sanctity as it was yesterday. Indeed, let the witness among you convey to the absent. Whoever tells you that the Messenger of Allah ﷺ fought in it, say: Indeed, Allah, Mighty and Majestic, made it lawful for His Messenger and did not make it lawful for you. O Khuza'ah, lift your hands from killing, for it has become frequent that it occurs. If you kill anyone, I will surely pay his blood money. Whoever is killed after this standing of mine, his family has the better of two options: if they wish, the blood of his killer, and if they wish, his blood money.'" Then the Messenger of Allah ﷺ paid the blood money for the man whom Khuza'ah killed. 'Amr b. Sa'id said to Abu Shurayh: 'Go away, old man, for we know its sanctity better than you. It does not prevent a shedder of blood, nor a renouncer of obedience, nor a preventer of disgrace.' He said: I said: 'I was a witness and you were absent. I have conveyed, and the Messenger of Allah ﷺ ordered us that our witness should convey to our absent, and I have conveyed to you. So you and your affair.'
