حَدَّثَنَا عَبْدُ الرَّزَّاقِ حَدَّثَنَا مَعْمَرٌ عَنِ الزُّهْرِيِّ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ
أَنَّ عُمَرَ بْنَ الْخَطَّابِ قَالَ: مَا أَرَى الدِّيَةَ إِلَّا لِلْعَصَبَةِ؛ لِأَنَّهُمْ يَعْقِلُونَ عَنْهُ، فَهَلْ سَمِعَ أَحَدٌ مِنْكُمْ مِنْ رَسُولِ اللهِ ﷺ فِي ذَلِكَ شَيْئًا ؟ فَقَالَ الضَّحَّاكُ بْنُ سُفْيَانَ الْكِلَابِيُّ، وَكَانَ اسْتَعْمَلَهُ رَسُولُ اللهِ ﷺ عَلَى الْأَعْرَابِ: كَتَبَ إِلَيَّ رَسُولُ اللهِ ﷺ أَنْ أُوَرِّثَ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا، فَأَخَذَ بِذَلِكَ عُمَرُ بْنُ الْخَطَّابِ.

✧ That 'Umar b. al-Khattab said: 'I do not see the blood money as belonging to anyone but the male relatives, because they pay on his behalf. Has any of you heard anything from the Messenger of Allah ﷺ about that?' Al-Dahhak b. Sufyan al-Kilabi, whom the Messenger of Allah ﷺ had appointed over the Bedouins, said: 'The Messenger of Allah ﷺ wrote to me instructing me to give the wife of Ashyam al-Dibabi an inheritance share from her husband's blood money.' So 'Umar b. al-Khattab adopted that.
