حَدَّثَنَا هُشَيْمٌ أَخْبَرَنَا خَالِدٌ عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ بْنِ جَوْشَنٍ عَنْ عُقْبَةَ بْنِ أَوْسٍ عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ
أَنَّ النَّبِيَّ ﷺ خَطَبَ يَوْمَ فَتْحِ مَكَّةَ فَقَالَ: لَا إِلَهَ إِلَّا اللهُ وَحْدَهُ، نَصَرَ عَبْدَهُ، وَهَزَمَ الْأَحْزَابَ وَحْدَهُ. قَالَ هُشَيْمٌ مَرَّةً أُخْرَى: الْحَمْدُ لِلهِ الَّذِي صَدَقَ وَعْدَهُ، وَنَصَرَ عَبْدَهُ، أَلَا إِنَّ كُلَّ مَأْثُرَةٍ كَانَتْ فِي الْجَاهِلِيَّةِ تُعَدُّ وَتُدْعَى، وَكُلَّ دَمٍ أَوْ دَعْوَى مَوْضُوعَةٌ تَحْتَ قَدَمَيَّ هَاتَيْنِ، إِلَّا سِدَانَةَ الْبَيْتِ وَسِقَايَةَ الْحَاجِّ، أَلَا وَإِنَّ قَتِيلَ خَطَإِ الْعَمْدِ، قَالَ هُشَيْمٌ مَرَّةً: بِالسَّوْطِ وَالْعَصَا وَالْحَجَرِ دِيَةٌ مُغَلَّظَةٌ: مِائَةٌ مِنَ الْإِبِلِ، مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا، وَقَالَ مَرَّةً: أَرْبَعُونَ مِنْ ثَنِيَّةٍ إِلَى بَازِلِ عَامِهَا، كُلُّهُنَّ خَلِفَةٌ

✧ The Prophet ﷺ gave a sermon on the day of the conquest of Makkah and said: 'There is no god but Allah alone. He aided His servant and defeated the confederates alone.' Hushaym said on another occasion: 'Praise be to Allah who fulfilled His promise and aided His servant. Indeed, every practice of merit that was counted and claimed in the Jahiliyyah, and every blood claim or demand is abolished under these two feet of mine, except the custodianship of the House and the provision of water for the pilgrims. Indeed, the killing of one killed by mistake resembling intentional killing—Hushaym said once: with a whip, a stick, or a stone—requires a heavy blood money: one hundred camels, of which forty are pregnant with their young; and he said once: forty from a two-year-old to one in its eighth year, all of them pregnant.'

machine translationThis is a hadith about which there is disagreement on the authority of al-Qāsim b. Rabīʿah. It is narrated from him from Ibn ʿUmar, and from him from Ibn ʿAmr. Ḥumayd al-Ṭawīl narrated it as a mursal report from al-Qāsim b. Rabīʿah, and Khālid al-Ḥadhdhāʾ said: from al-Qāsim, from ʿUqbah b. Aws, from Ibn ʿUmar. And this is more likely.
