حَدَّثَنَا وَكِيعٌ حَدَّثَنَا مِسْعَرٌ وَسُفْيَانُ عَنْ أَبِي حَصِينٍ عَنْ عُمَيْرِ بْنِ سَعِيدٍ قَالَ قَالَ عَلِيٌّ

مَا كُنْتُ لِأُقِيمَ عَلَى رَجُلٍ حَدًّا، فَيَمُوتَ، فَأَجِدُ فِي نَفْسِي مِنْهُ إِلَّا صَاحِبَ الْخَمْرِ، فَلَوْ مَاتَ وَدَيْتُهُ، وَزَادَ سُفْيَانُ: وَذَلِكَ أَنَّ رَسُولَ اللهِ ﷺ لَمْ يَسُنَّهُ

Translation

  4. ʿUmayr b. Saʿīd
  5. ʿAlī

✧ I would not carry out a prescribed punishment on a man and have him die, and then feel anything in myself about it, except in the case of the wine-drinker. If he died, I would pay his blood-money. Sufyan added: That is because the Messenger of God ﷺ did not institute it.
