حَدَّثَنَا زُهَيْرٌ، حَدَّثَنَا جَرِيرٌ، عَنْ عَطَاءِ بْنِ السَّائِبِ، عَنْ أَبِي ظِبْيَانَ، قَالَ:

أُتِيَ عُمَرُ بِامْرَأَةٍ قَدْ فَجَرَتْ، فَأَمَرَ بِهَا أَنْ تُرْجَمَ، فَمُرَّ بِهَا عَلَى عَلِيٍّ فَعَرَفَهَا، فَخَلَّى سَبِيلَهَا، فَأُتِيَ عُمَرُ، فَقِيلَ لَهُ: إِنَّ عَلِيًّا أَخَذَهَا مِنْ أَيْدِينَا فَأَرْسَلَهَا، فَقَالَ: ادْعُوهُ لِي، فَأَتَاهُ، فَقَالَ: لِمَ أَرْسَلْتَهَا ؟ قَالَ: وَاللهِ لَقَدْ عَلِمْتَ يَا أَمِيرَ الْمُؤْمِنِينَ أَنَّ رَسُولَ اللهِ ﷺ، قَالَ: قَدْ رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ: عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ، وَعَنِ الصَّبِيِّ حَتَّى يَبْلُغَ، وَعَنِ الْمَجْنُونِ حَتَّى يَبْرَأَ، وَإِنَّ هَذِهِ مَجْنُونَةُ بَنِي فُلَانٍ، وَلَعَلَّ الَّذِي فَجَرَ بِهَا أَتَاهَا وَهِيَ فِي بَلَائِهَا

Translation

✧ A woman who had committed fornication was brought to Umar, and he ordered that she be stoned. She was passed by Ali, and he recognized her, so he let her go. Umar was told: Ali took her from our hands and released her. He said: Call him to me. He came, and Umar said: Why did you release her? He said: By Allah, you know, O Commander of the Faithful, that the Messenger of Allah ﷺ said: The pen is lifted from three: from the sleeper until he wakes, from the child until he reaches puberty, and from the insane until he recovers. And this is an insane woman of Banu so-and-so, and perhaps the one who fornicated with her came to her while she was in her affliction.
