حَدَّثَنَا كَامِلُ بْنُ طَلْحَةَ، حَدَّثَنَا ابْنُ لَهِيعَةَ، حَدَّثَنَا جَعْفَرُ بْنُ رَبِيعَةَ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، أَنَّ رَسُولَ اللهِ ﷺ قَالَ:

أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذْنِ وَلِيِّهَا، فَنِكَاحُهَا بَاطِلٌ، وَإِنْ دَخَلَ بِهَا، فَلَهَا مَهْرُهَا بِمَا أَصَابَ مِنْ فَرْجِهَا، وَإِنِ اشْتَجَرُوا، فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ

Translation

✧ Whichever woman is married without the permission of her guardian, her marriage is invalid; her marriage is invalid; her marriage is invalid. And if he has consummated the marriage, she is entitled to her dower because of what he has attained from her private part. And if they dispute, then the sultan is the guardian of the one who has no guardian.
