حَدَّثَنَا أَحْمَدُ بْنُ صَالِحٍ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ وَهْبٍ أَخْبَرَنِي عَمْرٌو عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ
فِيمَا سَقَتِ الأَنْهَارُ وَالْعُيُونُ الْعُشْرُ وَمَا سُقِيَ بِالسَّوَانِي فَفِيهِ نِصْفُ الْعُشْرِ

The Messenger of Allah ﷺ as saying A tenth is payable on what is watered by rivers and brooks or from underground moisture and a twentieth on what is watered by draught camels.

قال النسائي رواه ابن جريج عن أبي الزبير عن جابر قوله ولا نعلم أحدا رفعه غير عمرو بن الحارث وحديث ابن جريج أولى بالصواب وإن كان عمرو أحفظ منه وعمرو من الحفاظ روى عنه مالك انتهى وإذا كان عمرو أحفظ من ابن جريج وقد رفعه فالرفع فيه زيادة وزيادة الثقة مقبولة وكأن حديث عمرو أولى بالترجيح شرحا لكلام النسائي
machine translationAl-Nasāʾī said: Ibn Jurayj narrated it from Abū al-Zubayr, from Jābir, as his own statement (mawqūf), and we do not know anyone who raised it to the Prophet (marfūʿ) other than ʿAmr b. al-Ḥārith. The hadith of Ibn Jurayj is closer to being correct, even though ʿAmr has a better memory than he does, and ʿAmr is among the memorizers (ḥuffāẓ); Mālik narrated from him. End of quote. And if ʿAmr has a better memory than Ibn Jurayj and has raised it, then the raising is an addition, and the addition of a trustworthy narrator (ziyādat al-thiqah) is accepted, and it seems that the hadith of ʿAmr is more deserving of preference. This is an explanation of the words of al-Nasāʾī.
